About this file
This is a Justification and Approval (J&A) document for a sole source procurement under the Service-Disabled Veteran-Owned Small Business (SDVOSB) authority for the Department of Veterans Affairs.
The Department of Veterans Affairs, Network Contracting Office 5, is procuring Eye Surgery Units (vitreoretinal cataract systems) for the DC VA Medical Center at 50 Irving Street NW, Washington DC 20022. The procurement is for UNITY Vitreoretinal Cataract Systems (VCSs) from O.R. Elder, Inc., a certified SDVOSB, under a new Firm-Fixed-Price contract. Specific items required include: Qty 2 ALCON UNITY VCS VLTP packages (including consoles, remotes, lasers, trays, footswitches, phaco handpieces, and related components), Qty 10 ALCON 4D PHACO handpieces, and Qty 1 ALCON OZIL fragmentation handpiece, all to be delivered within 90 days. The current equipment is nearing end-of-life with extensive downtime. The statutory authority for this sole source award is 41 USC §3304(a)(5) and 38 U.S.C. § 8127(c) under VAAR 819.7008, as the contractor qualifies as a certified SDVOSB responsible for performance.
A Sources Sought notice (36C24526Q0410) was issued for 10 business days and garnered zero responses. The manufacturer designated O.R. Elder, Inc. as the exclusive distributor for the VA and confirmed the items are U.S.-manufactured. Market research through FDA, GSA, NAC, SAM.gov, FPDS, and contracting archives found only the manufacturer as a source. Historical pricing from a prior VA contract (Order 36C25925P1190 awarded 9/18/2025) was used to determine fair and reasonable pricing. No alternative sources expressed interest. The justification is dated 5/1/26 and requires approval from the Contracting Specialist, Contracting Officer, and one level above the Contracting Officer (for procurements between SAT and $900K).
