The Department of Veterans Affairs, Network Contracting Office 2, and the VA Western New York Healthcare System (VAWNYHCS) in Buffalo, NY anticipate a procurement action and order for neurosurgical instrumentation for a new neurosurgery department at the Buffalo facility. It is requested and expected that the procurement will be conducted on a sole source/brand name only basis.
Estimated Cost:
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
The Neurosurgery department is a new addition to the VAWNYHCS and requires specific instrumentation to perform Neurosurgical procedures. Neurosurgical instruments are technically specific in precision and accuracy when performing procedures on delicate spinal tissue and bone.
This is one of five (5) brand name justifications for the neurosurgery instrumentation requirement.
Each of the 5 brand names constitute specific requirements for the particular types of neurosurgical procedures. The brand names requested are for use in specialized reusable medical equipment (RME) areas for the surgeries performed.
The neurosurgical procedures will be conducted by the same surgeons from Buffalo General Hospital (BGH) who perform these surgeries now for Veterans per an official contractual agreement between VAWNYHCS and BGH. The surgeons have requested identical instruments so that the surgical procedures can be performed at both locations without an inconvenience to the surgeons contracted by VA to perform delicate and intricate neurosurgical procedures.
The brand name required for this action is Biomet Microfixation.

Market research concluded that there are no SDVOSB or VOSB authorized vendors to sell these instruments on their behalf.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
