About this file

This document is a sole source justification for a federal contract award. The Department of Veterans Affairs, through its Network Contracting Office 21 and Veterans Integrated Service Network 21, requires brand name surveillance equipment from Bosch, Milestone, Axis, and Lenel to upgrade security systems at the VA Southern Nevada Healthcare System main hospital and various outpatient clinics. The equipment will integrate video surveillance across facilities and allow centralized monitoring from the main hospital. Estimated value is $1,703,212 to be awarded under simplified acquisition procedures as a 100% service-disabled veteran-owned small business set-aside. Market research identified two SDVOSBs as potential sources, and the contract was subsequently awarded to SCDATACOM LLC on September 27, 2022 for $1,479,156.

(VASNHCS). PR#: 593‐22‐2‐736‐0024

2. Nature and/or Description of the Action Being Processed: The action being review and approved is for a brand name only procurement. This procurement is for the installation of an internal security system at the VASNHCS main hospital and outlying Community Based Outreach Clinics (CBOCs) in accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR

13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303‐2.

‐ Brand name Bosch Motion/Intrusion Detection System (Qty 88).

‐ Brand name Milestone CCTV System (QTY 1).

‐ Brand name AXIS P3375‐V cameras (Qty 45).

‐ Brand name Lenel Wiegand Interface Unit Access Control Circuit Boards (QTY 900).

Include Bosch, Milestone, AXIS and Lenel Wiegand are the only manufacturers capable of providing the supplies described in Section 3 above without the Veteran’s Health Administration experiencing unacceptable delays in procurement and additional costs.

The total estimated value of this action is: $1,703,212.00

4. Statutory Authority Permitting Restricted Competition:

FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106‐1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

( ) Unusual and Compelling Urgency

Effective Date: 02/01/2022 Page 2 of 5

( ) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services

( ) International Agreement ( ) Authorized or Required by Statute ( ) National Security ( ) Public Interest

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

The VASNHCS requires the above brand name surveillance equipment to ensure system integration between the main hospital and outlying CBOCs. These specific brand names items are currently installed and utilized at the main hospital, for full system integration, the same brands must be installed at the outlying clinics. Like surveillance equipment is currently being installed at the main hospitals exterior under under contract 36C26122P0616 awarded February 12, 2022. This brand name continuity allows VA Police to have full access to the surveillance systems of the outlying clinics from their central main hospital location.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

Market research was conducted via VA Veterans Information Pages, GSA Advantage, NASA SEWP, and the System for Award Management. A search of VA VIP was conducted utilizing NAICS 334290 (Security Systems Services (Except Locksmiths) with keyword “Lenel” which identified one (1) SDVOSB vendor, SDVOSB HurtVet Subcontracting LLC. An RFI was issued to SDVOSB HurtVet Subcontracting LLC to identify if they were a viable source. HurtVet Subcontracting, LLC provided adequate information in response which determined that they possessed the capability and availability to meet the Government’s need. On August 10, 2022, the Contracting Officer posted a Sources Sought to NASA SEWP’s Group A which garnered zero responses from the thirty‐five contract holders. On August 17, 2022 the Contracting Officer determined that this requirement should be procured as a service. The primary driver in that determination is that more than $1 Million of the IGCE are service/labor related costs. These costs far exceed the equipment portion of the requirement. Therefore, it was determined that Service NAICS 561621 (Security Systems Services (Except Locksmiths) was more appropriate which resulted in an additional VA VIP search under NAICS 561621 (Security Systems Services (Except Locksmiths” with keyword “Lenel” which identified three (3) SDVOSB vendors identified. SDVOSB HurtVet Subcontracting, LLC was also identified utilizing this NAICS.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:

It has been determined that both labor and equipment costs for this requirement will be able to be determined fair and reasonable. Significant available online pricing exists for the suppy portion of the requirement, and labor and other services will be compared to historical contract 36C26122P0616, which is an ongoing project awarded to install new external surveillance equipment at the VASNHCS.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons

Market Research Was Not Conducted:

A search of VA VIP was conducted utilizing NAICS 334290 (Security Systems Services (Except Locksmiths) with keyword “Lenel” which aided in the identification of one SDVOSB vendor SDVOSB HurtVet Subcontracting LLC. An RFI was subsequently issued to SDVOSB HurtVet Subcontracting LLC to identify if they were a viable source. HurtVet Subcontracting, LLC provided adequate information in response which determined that they possessed the capability and availability to meet the Government’s need.

On August 10, 2022, the Contracting Officer posted a Sources Sought to NASA SEWP’s Group “A” which resulted in zero responses from the thirty‐five contract holders.

On August 17, 2022, the Contracting Officer determined that this requirement should be procured as a service. The primary driver in that determination is that more than $1 Million of the IGCE are service/labor related costs. These costs far exceed the equipment portion of the requirement.

Subsequently, it was determined Service NAICS 561621 (Security Systems Services (Except Locksmiths) was more appropriate, and therefore, an additional VA VIP search utilizing NAICS 561621 (Security Systems Services (Except Locksmiths” with keyword “Lenel” was completed which identified three (3) SDVOSB vendors. SDVOSB HurtVet Subcontracting, LLC was also identified using this NAICS.

SAM Searches were conducted for OEMs of brand name items being requested in this requirement (Axis, Lenel, Bosch, Milestone) which determined that all were large businesses. Additionally, SAM Verifications were conducted on the two SDVOSBs identified as potentially capable of meeting the Government’s need; DK & R Corp, and HurtVet Subcontracting, LLC.

A search of GSA determined that required supplies are not available through one GSA Schedule holder. Specific results outlined below:

‐ AXIS P3375‐V Security Camera – available from 13 Vendors.

‐ Lenel OnGuard V8 – V8 version not available via GSA.

‐ Bosch Motion Detection Sensors – not available via GSA.

‐ Milestone Camera System – not available
