VHAPM Part 813.106 Page 1 of 2 Original Date: 08/30/17 Revision 02 Eff Date: 03/31/2020

DEPARTMENT OF VETERANS AFFAIRS

Brand Name Justification IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C260-20-AP-4313

1. Contracting Activity: Department of Veterans Affairs NCO 20 on behalf of VISN 20, Roseburg, OR

Medical Center (2237 Number: 653-20-4-9961-0110)

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: This requirement is for 20 Liko Lift 250 ES Motor Packages (must work with current systems Liko) to include authorized certified installation at the Roseburg VAMC. Estimated total cost is $72,911.60.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

Essential/significant physical, functional, or performance characteristics.

• Ability to support up to 550-pound patient.

• Must be compatible with current fleet of Liko safety latch sling bars.

• Consistent recharging system, either extended charging system, or docking charging system.

• Must have emergency stop cord accessible from the ground.

• Must have Audible and visual LED low battery indicator

• Must have a manual emergency lowering device located on the motor cab.

Compatibility – Must be compatible with current Liko safety latch sling bars.

Purpose – This will be used to lift patients from beds, as well as patients that may have fallen

4. Description of market research conducted and results or statement why it was not conducted:

This item must work with current Liko products that are already in place. Items were recently procured in April of 2020 at another VISN 20 Medical Center. Extensive research was conducted on GSA, FSS, SEWP GWAC and mandatory VA contracts. It appears that these items requested are not available on any current Government contracts. The manufacturer of the requested equipment does work with authorized small business and SDVOSB vendors. However due to the fact that there is no SBA non-manufacturer waiver for this specific type of equipment under NAICS 339113, the VA “Rule of two for SDVOSB” cannot be met in this situation, this will be solicited as a small business set-a-side to authorized sellers only.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.

Note: COs are required to make a determination of price reasonableness IAW FAR 13.106-3. See the https://www.acquisition.gov/?q=/browse/far/13 https://acquisition.gov/far/current/html/Subpart%2013_1.html#wp1125466
