(4) Identify the Authority and Supporting Rationale
FAR 8.405-6(a)(1)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized. This is a brand name sole source specific to the Vocera platform. The onsite representative is an employee of the contractor with clearance privileges to the VA and is authorized to perform the upgrades and maintenance to Vocera servers. To perform the upgrades and have Vocera server upgrades and access, the onsite rep must be an employee of Vocera (OEM). This service is offered through the GSA Contract to Government Marketing and Procurement LLC. The vendor has provided a proprietary letter detailing the proprietary nature of this procurement.
Describe Why You Believe the Order Represents the Best Value consistent with FAR 8.404(d) to aid the contracting officer in making this best value determination: To meet the regulatory requirements as required by FAR Part 8.404(d) the Contracting Officer has determined that this sole source, firm fixed price delivery is fair and reasonable based on both the validity of the comparison and the price reasonableness of previous award prices, market research, and the Independent Government Cost Estimate. Vocera prices are consistent for similar services on the previous contract. The quoted pricing was verified with the vendor.
Vendor states that base year costs are prorated amounts to align all items covered to the same period of performance on the subsequent years. The pricing for subsequent option years is priced at full year for the services.
Describe the Market Research Conducted The vendor, Government Marketing and Procurement is a Service Disabled Veteran - Owned Small Business that holds the GSA contract for Vocera and their products under GSA Contract number GS-35F-0858N. No other vendors are authorized to perform this contract under the OEM. A search was conducted on the Vendor Information Pages using NAICS code 541519 with keywords “Vocera Premium Support Services”. There were 707 vendors returned on the search however, only Government Marketing and Procurement is authorized by the OEM to perform this requirement. In addition, a Notice of Intent to Sole Source was posted to Beta Sam from October 5, 2021 to November 5, 2021. No vendors responded objecting to the Intent to Sole Source.
Any Other Facts Supporting the Justification: The Vocera system allows hands-free communication with devices being located underneath personal protective equipment. With the pandemic, this functionality allows greater communication with less chance of cross contamination carried on the device. The continued use of these hands-free devices is necessary for risk management and safety of VA Healthcare employees and patients. The devices are fully compatible with existing systems and are maintained by Vocera personnel to ensure devices are fully operational and all software and licenses are up to date. Due to the equipment being proprietary, all additional pieces and services must be purchased using the GSA contract and serviced only by onsite Vocera personnel through Government

Marketing and Procurement LLC. No other company is authorized by the OEM to perform the requirement. Other brands would not integrate with the current system and using outside personnel would void warranties for services on Vocera’s systems and equipment. The use of other sources would also cause high risk of failures, impact patient care and limit the providers accessibility to hands free communications. Other brand name products, parts, and software necessary for maintenance of the systems are not compatible and will cause system/communications failures. The current contract for support services expires on February 28, 2021 and this contract is intended to provide continuity of service without interruption.
(8) A Statement of the Actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made: Due to the proprietary nature of the service, no additional actions can be taken to overcome barriers in competition.
(9) Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge. I understand that processing of this limited sources justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by FAR Subpart 8.4.
