About this file

This Limited Sources Justification document details a procurement by the Department of Veterans Affairs (Cincinnati VA Medical Center) for 43 ophthalmic exam chairs and chair glides. The acquisition will be conducted under the Multiple-Award Schedule Program with a total estimated value of $332,399.89, awarded to Lombart Brothers, Inc. as a new Firm Fixed Price requirement against Federal Supply Schedule contract 36F79722D0203. The chairs feature advanced capabilities including memory programming, dual-side operation controls, adjustable headrests and armrests, power tilt, 350° swivel functionality, and a large hinged footrest. The VA is specifically seeking these chairs to ensure compatibility with existing equipment in their exam rooms, and market research confirmed that Lombart Brothers is the only vendor capable of providing these specific components. The procurement was justified under FAR 8.405-6(b) for items peculiar to one manufacturer, with neither the VA Rule of Two nor SBA Rule of Two being satisfiable in this procurement.

LIMITED SOURCES JUSTIFICATION

ORDER >SAT

FAR PART 8.405-6

Acquisition Plan Action ID: 36C250-25-AP-3574

(1) Contracting Activity: Department of Veterans Affairs, NCO10, Cincinnati VA Medical Center (VAMC), Cincinnati, OH, submitted 2237 # 539-25-3-050-0027 for Ophthalmic Exam Chairs.

(2) Description of Action: This acquisition is conducted under the authority of the Multiple-Award Schedule Program (41 U.S.C. 152(3) and 40 U.S.C. 501). This will be awarded as a new Firm Fixed Price requirement for the Cincinnati VAMC against a FSS Agency Authority Government contract 36F79722D0203.

Order against: FSS Contract Number: 36F79722D0203

Name of Proposed Contractor: Lombart Brothers, Inc Street Address: 11825 Central Parkway City, State, Zip: Jacksonville, FL 32224 Phone: 855-777-2020

(3) Description of Supplies or Services:

The estimated value of the proposed action is $332,399.89

The Cincinnati VAMC requires 43 additional and replacement ophthalmic chairs and chair glides for three locations. These chairs and chair glides will be used in the Eye Center Exam rooms and will make Veteran Exams and procedures more efficient and easier for both the Veteran and the Providers. These chairs allow for: memory programming, dual-side operation controls, adjustable headrest and armrests single-hand lock, power tilt, dual-rotation locks allowing 350° swivel without moving, large hinged footrest safely for a patient’s full weight, and detached footswitch alowing for hands-free patient positioning.

As these are additional to the currently used chairs, it is imperative that we have the same make of ophthalmic chair and chair glides so they are compatible with the Ophthalmic Chair Room/Chair Glides currently in all Exam Rooms.

(4) Identify the Authority and Supporting Rationale (see below and if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

FAR 8.405-6(a)(1)(A): An urgent and compelling need exists and following the ordering procedures would result in unacceptable delays:

FAR 8.405-6(a)(1)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized;

FAR 8.405-6(a)(1)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under sole source or limited source procedures.

FAR 8.405-6(b): Items peculiar to one manufacturer:

A patent, copyright or proprietary data limits competition. The proprietary data is:

These are “direct replacements” parts/components for existing equipment.

The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing: It is necessary that we have the same make of ophthalmic chair and chair glides so they are compatible with the Ophthalmic Chair Room/Chair Glides currently in all Exam Rooms.

(5) Describe Why You Believe the Order Represents the Best Value consistent with FAR 8.404(d) to aid the contracting officer in making this best value determination: The VA is unable to satisfy the Cincinnati VA Medical Center requirements for supplies from the mandatory sources listed in FAR 8.002 and FAR

8.003. The use of a non-mandatory source, Federal Supply Schedules, per FAR 8.0004(a)(1) has been determined to represent the best value and will result in the lowest overall cost alternative, considering price and administrative costs, to meet the VA’s needs. Supplies offered on the schedule are listed at fixed prices. The General Services Administration (GSA) has already determined the prices of supplies under schedule contracts to be fair and reasonable.

(6) Describe the Market Research Conducted among schedule holders and the results or a statement of the reason market research was not conducted: DSBS queried using NAICS code 339115 and keywords “chair” or “exam” with 0 SD/VOSB’s located. Conducted a VetCert query by same NAICS with 141 results. Product not in NMR Class Waiver List. Items can be found on NAC by only one vendor, Lombart Brothers, Inc dba Marco Lombart. Neither the VA Rule of Two nor SBA Rule of Two can be satisfied.

(7) Any Other Facts Supporting the Justification: None

(8) A Statement of the Actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made: None

(9) Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge.
