(2) Description of Action: This acquisition is conducted under the authority of the Multiple Award Schedule Program (41 U.S.C. 152(3) and 40 U.S.C. 501). This is a new, brand name, sole source requirement.

The Contracting Activity is looking to acquire (1) Pelican Mechanical Sweeper (Model No. PELICAN P DUAL T4). This sweeper is being manufactured by OEM large business Elgin Sweeper Company (UEI:
JAUMQM3N4WH4) 1300 West Bartlett Road, Elgin, IL 60120. The Elgin Pelican broom sweeper is a three wheel mechanical sweeper based on one of the original street sweeper designs, which has been continuously improved since 1914, meeting the highest sweeper standards. Maneuverability, visibility, economy, serviceability, and single lane dumping with a sweep system that easily handles heavily compacted dirt and bulky debris are all features of the Elgin Pelican. An isolation mounted cab provides a cleaner, quieter operation, and the improved 360 degree visibility and easier access for service and maintenance make the Elgin Pelican an industry leader in road sweepers.
(4) Identify the Authority and Supporting Rationale (see below and if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
FAR 8.405 6(a)(1)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; The Elgin Pelican sweeper demonstrates a unique and innovative concept that has led the mechanical street sweeping industry since the invention of the first 3 wheeled Elgin Sweeper in 1914. VA WCM facility’s main goal is safety. The Pelican’s isolation mounted cab provides a clean, quiet, and comfortable environment for the operator. The large windows, see through doors, and full width windshield allow

Effective Date: 02/01/2022 Page 2 of 3 for 360° degree visibility. This allows the operator to safely navigate the roads and parking lots avoiding “blind spots” as seen in any other model. In addition to the added safety, it supports the unique spaces larger units will not while still being able to cover full roads. This equipment is used year round often multiple times a week making rental or service contract not viable.
(5) Describe Why You Believe the Order Represents the Best Value consistent with FAR 8.404(d) to aid the contracting officer in making this best value determination: This is a brand name request for the specific unit. This is the only 3 wheeled unit available which meet the needs of the facility for sweeping requirements. The pedestrian and vehicle traffic at the VA CWM campus is a very dynamic environment.
The campus has many parking lots that are always busy. This is the only rear steer unit offering outstanding maneuverability. Due to its design, it offers an unobstructed 360 degrees of operator visibility. Additionally, the facility is 100 years old resulting in layout and geometry that requires agility in tight spaces. This is accomplished by front mounting a variable high dump 3.6 yd3 (2.8 m3) hopper below the operator position. The market research shows the selected unit is significantly cheaper than the larger traditional truck body units while maintaining the necessary capacity. This unit was found on
GSA.
(6) Describe the Market Research Conducted among schedule holders and the results or a statement of the reason market research was not conducted. Traditional sites such as VetCert, GSA eLibrary, SBA DSBS, and FPDS were searched. The Contracting Activity conducted its first search on VetCert using NAICS 333120 which yielded 926 broad results, none of which are authorized to provide this sweeper.
GSA search under manufacture “ELGIN SWEEPER COMPANY” produced 1 schedule contractor SB MARYLAND INDUSTRIAL TRUCKS, INCORPORATED who is their sole authorized distributor. FPDS search using keyword “Pelican Sweeper” yielded 1 contract action, which was a purchase for the same equipment by the DEPT OF THE ARMY, however no contract actions for the department of veteran affairs. Lase search was on SBA DSBS using keyword “Elgin Sweeper” yielded 1 profile, SB Yukon Equipment Inc whose capabilities statement state they sell Elgin Sweepers; however, they are an unauthorized reseller. All market research leads to small business MARYLAND INDUSTRIAL TRUCKS, INCORPORATED being the only company authorized by OEM LB Elgin Sweepers and able to provide this street sweeper. Since this requirement is above an intent to sole source notice will be published on Contract Opportunities. The rule of two was not met.
(7) Any Other Facts Supporting the Justification: Northampton VA Medical Center requires a new street sweeper to replace an existing unit no longer in use as it is beyond economical repair. The function of the street sweeper to remove debris from roads to reduce the risk of accidents and injuries for drivers, pedestrians, runners, and cyclists. The Sweeper will also remove hazardous materials like broken glass and nails. This is also required to support storm water routing and comply with local environmental regulations. Street sweepers can improve water quality by preventing pollutants from entering streams and stormwater systems. They can also remove brake dust and other airborne particles, which can improve air quality.
(8) A Statement of the Actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made: None.

(9) Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge. I understand that processing of this limited sources justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by FAR Subpart 8.4.
