Authority:

An urgent and compelling need exists, and following the procedures would result in unacceptable delays(FAR 8.405-6(a)(1)(i)(A);

Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized;

(FAR 8.405-6(a)(1)(i)(B));

In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order and the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order was not previously issued under sole-source or limited-sources procedures (FAR 8.405- 6(a)(1)(i)(C)); or

Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer). A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer (FAR 8.405-6(b)).

4. Rationale/explanation to support cited authority

The entire fleet of patient monitors at the Beckley VA Medical Center are Philips brand. The requested items were previously purchased on DLA ECAT on order 517-B00002 on August 10, 2020. The Philips Healthcare upgrade, 36F79720D0042 36C24523F0669, was awarded on August 25,2023. The requested monitors and associated equipment were not included in this acquisition because they had not reached the end of life. Having Philips patient monitors on the anesthesia carts will provide consistency in the patient monitoring interface used by the Beckley staff. The use of the Philips X3 will allow for transport and maintaining the patient’s vitals throughout their stay at the medical center. The supplies used with the patient monitors

The requirement is for replacement patient monitors on the anesthesia carts at the Beckley VA Medical Center. The monitors had not been planned for replacement, as they are not beyond their anticipated life expectancy. However, it was determined that the monitors cannot meet the requirements of the Draeger Innovian Anesthesia Record Keeper (ARK) project. They will not be able to trend vital signs and provide that information to the patient record, which is a main functionality of the ARK. GE cannot upgrade the existing monitors to meet the needs of the ARK; they said that they can only be replaced. The site is procuring replacement Philips patient monitors to allow for trending of the patient vitals throughout their stay at the VA.
