Effective Date: 02/01/2022 Page 1 of 3
DEPARTMENT OF VETERANS AFFAIRS
FAR 8 – Justification for Limiting Sources (LSJ) For
Limiting Sources (<SAT)
Acquisition Plan Action ID: 36C241-22-AP-3975
1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office 1, Northampton VA Medical Center located at 421 North Main Street, Leeds, MA 01082 in support of VISN 1 West Haven VA Medical Center located at 950 Campbell Ave, West Haven, CT 06516.
2. Description of Action: This is a new requirement to be awarded off the FSS contract below.
Order against: FSS Contract Number: V797D-70250 (End Date: 3/14/2023)
Name of Proposed Contractor: U.S. Instruments Inc.
Street Address: 500 N Main Street City, State, Zip: Lanoka Harbor, NJ 08734 Phone: 1-800-458-1170
3. Description of Supplies or Services:
The estimated value of the proposed action is $68,616.70
This is a new requirement for two (2) Parks Flo-Lab 2100-SX2 and one (1) USI Disposable 10cm Cuff. The Flo-Lab 2100-SX2 is a non-invasive vascular system that is a fully integrated vascular diagnostics instrument for hospitals and laboratories. The Flo-Lab 2100-SX2 helps clinicians perform their job fast, easier and with greater satisfaction, resulting in better diagnosis and care to their patients. The Flo-Lab 2100-SX2 can perform a variety of vascular studies, including upper and lower arterial studies and venous studies.
The current vascular system has reached the end of its life due to its Windows 7 operating system that is no longer supported by the OEM. An unsupported operating system can no longer receive the most up to date patching to protect the system against cyber-attacks. The new vascular system must have DICOM capability to interface with our VISTA Imaging storage database and must transmit the patients’ images to the hospital Electronic Medical Records (EMR). The data format is proprietary to the manufacturer’s software and cannot be imported into another manufacturer’s software.
Market Research: A search of VIP including NAICS 334510 and key word Vascular yielded 4 results. A search including NAICS 334510 and keyword Flo-Lab yielded zero results. Customer
Effective Date: 02/01/2022 Page 2 of 3 searched ECAT website with keywords “Flo-Lab 2100 SX2” resulting in zero matches. Searched GSA Advantage for Parks Flo-Lab 2100-SX2 yielding once result sold and shipped by WOSB U.S.
Instruments Inc. A search of DSBS including NAICS 334510 and Keyword Vascular yielded 9 results to include WOSB US Instruments Inc. There are not two or more VIP-listed SDVOSBs or VOSBs capable of providing the requirement nor likely to submit a quote at a fair and reasonable price. The requirement shall be sole sourced to WOSB US Instruments Inc. off their GSA contract V797D-70250.
4. Authority:
Order Against FSS: Authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 USC 251, et seq.); Title 40 USC 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6. Mark the applicable exception:
An urgent and compelling need exists, and following the procedures would result in unacceptable delays(FAR 8.405-6(a)(1)(i)(A);
Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized;
(FAR 8.405-6(a)(1)(i)(B));
In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order and the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order was not previously issued under sole-source or limited-sources procedures (FAR 8.405- 6(a)(1)(i)(C)); or
Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer). A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer (FAR 8.405-6(b)).
5. Rationale/explanation to support cited authority: This request is to replace the existing two Parks Flo-Lab vascular systems. Both units have outdated operating systems that are no longer supported by the vendor, which poses a risk to the cybersecurity of the devices. The newest model of the Parks Flo-Lab vascular system is the only brand name product that will allow the data from our old system to be transferred and imported into a new system. The database will remain intact on the new system for instances that the clinician needs to review an older study for comparative purposes or reprint a report from the old system. The data format is proprietary to the manufacturer’s software and cannot be imported into another manufacturer’s software. The equipment is manufactured by Park Medical Electronics Inc.
Effective Date: 02/01/2022 Page 3 of 3
6. Note that this determination satisfies the requirements of FAR 8.405-6. The requirement to prepare a written justification IAW FAR 6.303 does not apply to Federal Supply Schedules.
