About this file

This is a Justification for Limiting Sources (LSJ) document from the Department of Veterans Affairs for procuring LexisNexis Accurint online investigative tool at the Thomas E. Creek Medical Center in Amarillo, TX. The document justifies using a sole source procurement through FSS Contract Number GS-00F-178DA with LexisNexis Risk Solutions.

The justification explains that LexisNexis is the only vendor capable of providing the required services due to their patent-pending LexID technology, which links 270 million identities with 99.9% accuracy and provides unique features like motor vehicle registration wildcard search capabilities. The system allows law enforcement to query partial license plate information and vehicle details, delivering comprehensive reports in under 5 seconds. The procurement will exceed $25,000 and will be posted on e-Buy along with an RFQ. The document is effective September 1, 2024, and is signed by Contract Specialist Jesus Casiano and Contracting Officer Donald Smith.

Order against: FSS Contract Number: GS-00F-178DA.

Name of Proposed Contractor: LexisNexis Risk Solutions Street Address: 1000 Alderman Drive City, State, Zip: Alpharetta, GA 300005-4101 Phone: 937.238.2745

3. Description of Supplies or Services:

The estimated value of the proposed action is

Lexisnexis Accurint online investigative tool. Customer contacted multiple companies that provide web-based record information; however, LexisNexis was the only vendor that could meet the needs of the service. Contracting did a FPDS search and found that only vendor that has been awarded Accurint software is LexisNexis.

4. Authority:

Order Against FSS: Authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 USC 251, et seq.); Title 40 USC 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6. Mark the applicable exception:

An urgent and compelling need exists, and following the procedures would result in unacceptable delays(FAR 8.405-6(a)(1)(i)(A);

Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; (FAR 8.405- 6(a)(1)(i)(B));

VHAPG Part 808.405-6 Limiting Sources Page 2 of 2 Revision: 01 Effective Date: 09/01/2024 Acquisition ID#: 36C257-24-AP-5179 applicable Federal Supply Schedule ordering procedures. The original order was not previously issued under sole-source or limited-sources procedures (FAR 8.405-6(a)(1)(i)(C)); or

Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer). A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer (FAR 8.405-6(b)).

5. Rationale/explanation to support cited authority: LexisNexis Risk Solutions (LNRS) is the sole source provider of Accurint for Law Enforcement. LexisNexis uses patent pending linking technology, only available through LexisNexis solutions which allows the user to take multiple data sources for each record type and uses advanced business intelligence technology to deliver information most relevant to an investigation. The LexID combines data integrity with technology, to dramatically increase precise linking which in return, provides phone numbers, motor vehicle and property information, address, and business information. LexID is the only patent pending technology that links 270 million identities with a 99.9% linking capability. In addition, LexID is the only software that provides motor vehicle registration wildcard search, which enables law enforcement to query different combinations of motor vehicle data to run on partial license plate tags as well as car makes, models, color, type, and provide information to if the vehicle has been involved in a crime, or combination of events, speeding etc. LexID is the only digital source at this time that provides this level of application performance, combining motor vehicle data on partials for vehicle information searches. A full LexisNexis comprehensive report will run in under 5 seconds, which no other agency can provide. This information being readily available to the officers allows them to better process and react accordingly to better protect and serve the veterans at the VA facilities. Additionally, the use of another software technology will result in the Government paying for and administering two separate contracts, which would increase costs and time allotted to the acquisition and administration of those contracts.

6. BRAND NAME ONLY : This buy is estimated to exceed $25,000 and this documentation will be posted along with the RFQ on e-Buy, as required by FAR 8.405-1(e).

7. Note that this determination satisfies the requirements of FAR 8.405-6. The requirement to prepare a written justification IAW FAR 6.303 does not apply to Federal Supply Schedules.
