LIMITED SOURCES JUSTIFICATION SUMMARY

This is a Limited Sources Justification document for a sole-source acquisition under FAR Part 8.405-6 using the Federal Supply Schedule (FSS) program. The Department of Veterans Affairs, VISN 23 (Minneapolis Medical Center, Network Contracting Office 23) is seeking to award an order valued at $740,000.00 to Johnson Controls Inc. for Metasys Building Automation System Services and maintenance. The contractor is located at 2605 Fernbrook Lane North, Plymouth, MN 55447. The acquisition is being conducted against FSS Contract Number GS-07F-190CA, and no options are included in this procurement. Johnson Controls Inc. is classified as a large business.

The justification for sole sourcing is based on FAR 8.405-6(a)(1)(B), establishing that only one source is capable of providing the required supplies and services at the required quality level because the supplies and services are unique and highly specialized. Specifically, due to proprietary software and hardware communications inherent to the Metasys system already installed at the facility, Johnson Controls Inc. is the only responsible and capable source authorized to perform maintenance and service on this equipment. No third parties are currently authorized by Johnson Controls to provide these services. The acquisition does not meet the VA Rule of Two or SBA Rule of Two requirements. Market research was limited due to the proprietary nature of the requirement. The justification was certified by Carl Berning (Engineering Technician, Minneapolis VAMC), approved by Contracting Officer Joey Bloomer (NCO23/SST4), and reviewed by Michael Casper (NCO23/Branch Chief).
