About this file

This document is a sole source justification for a contract between the Department of Veterans Affairs Veterans Health Administration Veterans Integrated Service Network 23 and Diasorin for the purchase of reagents and consumables compatible with DiaSorin Liaison XL equipment owned by VISN 23 labs. The five-year IDIQ contract is expected to award by August 1, 2023 and will establish firm fixed pricing for DiaSorin reagents required to perform clinical laboratory tests including infectious disease, tumor markers, gastrointestinal disease, hepatitis, retroviruses, metabolic disorders, and endocrine testing. A sole source justification is being filed under FAR 13.5 citing that DiaSorin, as the original equipment manufacturer, is the only responsible source capable of providing compatible reagents and ensuring the equipment functions properly without substantial cost duplication that cannot be recovered through competition. Market research found no other offers could meet requirements.

ITEMS IN ACCORDANCE WITH FAR 13.5

Acquisition Plan Action ID: 36C263-23-AP-2426

1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office 23 (NCO23) in support of VISN 23 Labs

2. Nature and/or Description of the Action Being Processed: This procurement is for a new contract in accordance with FAR 13.5 (Simplified Procedures for Certain Commercial Items) and specifically FAR 13.501( Special Documentation Requirements). 3. Description of Supplies/Services Required to Meet the Agency’s Needs: Diasorin Reagents are required to properly perform clinical laboratory tests that include infectious disease, tumor markers, gastrointestinal disease, hepatitis and retroviruses, metabolic disorders, and endocrine testing.

4. Statutory Authority Permitting Restricted Competition:

The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): DiaSorin is the original equipment manufacturer (OEM) for the government’s system, as well as compatible reagents and consumables that are processed on the proprietary DiaSorin Liaison XL. VISN 23 Pathology and Laboratory Division requires reagents and consumables for this essential, highly specialized equipment which can only be provided by DiaSorin, a large business.

DiaSorin does not possess authorized distributors for this requirement. DiaSorin is the only firm capable of providing the consumables in statement of work, as well as ensuring that the Veteran Health Administration does not experience a substantial duplication of cost.

The duplication of cost cannot be expected to be recovered through competition and unacceptable delays in fulfilling this requirement:
