5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Only one source can provide Temporary Nursing Services to Sacramento VA Medical Center at this time. The previous contract ended 31 March 2024, there is not a long-term contract in place at the moment. A six-month contract is required to allow time for a long-term contract to be put in place. The current vendor, Associated Health Professionals, Inc. is onsite at this facility daily providing services with satisfactory performance. The staff assigned to the Sacramento VA Medical Center have been vetted and credentialed to provide services at this facility. During this time a long-term contract will be put in place through competitive solicitation. Due to the need to re-solicit this requirement a short-term contract must be completed. Without this short-term contract it is impossible to put another vendor in place the risk of a lapse in service is a concern to patient care and safety. To mitigate this risk a short-term contract will be put in place.

Accordingly, Associated Health Professionals Inc., is the only firm capable of providing the services described in Section III above without the Veteran’s Health Administration experiencing unacceptable delays in fulfilling its requirements.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Re-solicitation will be completed once a short-term contract is put in place. The previous solicitation 36C26124Q0282 was canceled due multiple vendors ineligibility.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable: Price reasonableness will be completed prior to awarding the contract.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:

Market Research Findings: SBA Dynamic Small Business Search on 04/1/2024, using NAICS 561320, keyword: Licensed Practical Nurse. (0) Results Found. SBA Veteran Small Business Certification on 04/01/2024. Searching NAICS 561320. Zero results found.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: The current vendor, Associated Health Professionals, Inc. is onsite at this facility daily providing services with satisfactory performance. The staff assigned to the Sacramento VA Medical Center have been vetted and credentialed to provide services at this facility.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Associated Health Professionals INC., is currently providing Temporary Nurse Staffing Services and is willing to continue providing services to the Veterans of VANCHCS.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Re-solicitation will be completed competitively though open market.
