About this file

This document is a Sole Source Justification under FAR 13.5 for the Department of Veterans Affairs (VA) Canandaigua Medical Center. The VA requires ceiling lifts for all CLC (Community Living Center) cottages, specifically seeking to procure Handicare ceiling lifts from Handicare USA LLC as the sole source vendor. The justification explains that the original construction contract had ceiling lifts procured and installed by the vendor, but a modification now requires the VA to separately purchase the lifts. Procurement from another source would necessitate months of layout and structural approvals, potentially delaying construction, impacting patient care, and causing substantial cost duplication.

The document outlines the procurement as a one-time, firm fixed-price purchase under the Simplified Acquisition Procedures for Commercial Items, with a statutory authority citing only one responsible source capable of meeting agency requirements. The VA conducted market research by querying government-wide contract databases and determined that Handicare USA LLC is the only firm that can provide the specific ceiling lifts without causing unacceptable delays or cost inefficiencies. The procurement is for the Canandaigua VA Medical Center located in Canandaigua, NY, with an effective date of 11/15/24 and is marked as Revision 01.

REVISION: 01

DEPARTMENT OF VETERANS AFFAIRS

SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL

ITEMS IN ACCORDANCE WITH FAR 13.5

1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office 02, in support of VISN 02 VA Fingerlakes Health Care Systems, Canandaigua VA Medical Center, located at 400 Fort Hill Ave, Canandaigua, NY 14424.

2. Nature and/or Description of the Action Being Processed:

The intent of the Department of Veterans Affairs, Canandaigua VA Medical Center at 400 Fort Hill Ave, Canandaigua, NY 14424 is to outfit all the CLC cottages with ceiling lifts for the veteran population.

3. Description of Supplies/Services Required to Meet the Agencys Needs:

REVISION: 01

4. Statutory Authority Permitting Restricted Competition:

FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

(X) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements

( ) Unusual and Compelling Urgency ( ) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert

Services ( ) International Agreement ( ) Authorized or Required by Statute ( ) National Security ( ) Public Interest

5. Demonstration that the Contractors Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

An urgent and compelling need exists and the requested vendors products and services have been approved by the contracted construction vendor for delivery of specific Handicare ceiling lifts. The original construction contract for the CLC cottages had the ceiling lifts procured and installed by the vendor. A modification was made and the VAMC is now required to procure the ceiling lifts seperately. The timelines for award and delivery need to stay within the construction parameters. To procure from another source would require several months of verifying layout and structural approval for a different type of lift. Soliciting a different lift would delay construction and the opening of the CLC cottages. This would impact patient care, result in unacceptable delays in fulfilling the requirement, and cause a substantial duplication of cost that could not be expected to be recovered through competition.

Accordingly, HANDICARE USA LLC the original equipment manufacturer, is the only firm capable of providing the supplies and services described in Section III above without the Veterans Health Administration experiencing substantial duplication of cost that could not be expected to be recovered through competition and unacceptable delays in fulfilling its requirements.

Effective Date: 11/15/24 Page 3 of 4

REVISION: 01

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

The original construction contract for the CLC cottages had the ceiling lifts procured and installed by the vendor.

A modification was made and the VAMC is now required to procure the ceiling lifts.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:

Market research was conducted by querying the Government-wide database of contracts and other procurement instruments intended for use by multiple agencies available at www.contractdirectory.gov and other Government and commercial databases that provide information relevant to agency acquisitions. The original construction contract for the CLC cottages had the ceiling lifts procured and installed by the vendor. A modification was made and the VAMC is now required to procure the ceiling lifts.
