About this file
This document is a Justification for Other Than Full and Open Competition (JOFOC) for a succeeding lease at the Department of Veterans Affairs.
The Veterans Health Administration seeks to lease 41,036 rentable square feet (RSF) of space at 14 Tri Park Way, Appleton, Wisconsin 54914-1658 for Primary Care, Physical Therapy, Lab Services, Imaging Services, Eye Care, Cardiology, Pharmacy, and administration services. The current lease (VA101F-15-L-0025) expires March 31, 2025. The VHA requests approval to negotiate a succeeding lease with the incumbent lessor without full and open competition under GSAR 570.402. The lease term is 10 years (7 years firm/3 years non-firm) commencing April 1, 2025. The facility must remain within the delineated area bounded by North Highway 41, East Highway 441, South Highway 441, and West County Road CB. Estimated annual costs are redacted in the document, with a total contract value also redacted. A tenant improvement allowance is included in the lease term value.
The justification cites 41 U.S.C. 3304(a)(1) as statutory authority, asserting that only the incumbent lessor can satisfy agency requirements. Market research conducted October 22, 2024 identified three comparable alternative locations in the Appleton area via CoStar, but relocation costs and duplication expenses make remaining at the current location cost-beneficial. The incumbent lessor's performance under the current lease is satisfactory. A sources sought advertisement was posted on SAM.gov November 1, 2024 for seven days, resulting in no written expressions of interest. The document is certified by VHA Lease Contracting Officer Julie LeCourt and approved by Hans Lorenzini (Branch Chief, NCO15 Specialized Team) and John D. Thomas (Associate Executive Director, Office of Real Property).

8. OTHER FACTS SUPPORTING USE OF OTHER THAN FULL AND OPEN COMPETITION.
The Appleton CBOC is 41,036 RSF. The building was specifically built for the CBOC. After completing a cost benefit analysis of the lease, the cost of moving is costly. The long-term plan of the Appleton CBOC and neighboring Annex is to combine the facilities into one large facility. It is not economically advantageous for the clinic to move at this time, the intent is to stay in place with a succeeding lease. The VA LCO has confirmed the Lessor’s performance under the current lease has been satisfactory and the building is in acceptable condition.
9. LIST OF SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THE
ACQUISITION.
None
10. STATEMENT OF ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME
ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION.
There are no systemic barriers to competition. If the agency has a continuing need for space upon lease expiration, VHA will follow all authorities, regulations and policies applicable to lease acquisition. Should there be remaining useful life in the Government’s tenant improvements, the Government will consider the cost of moving from the existing location, and the cost to build out new space when deciding whether to undergo competitive action.
Additionally, objective scrutiny will be given to the customer agency’s mission and security requirements (if applicable) to eliminate unnecessary agency space requirements that may be deemed unduly restrictive.

By signature on this Justification for Other than Full and Open Competition, the VHA Lease Contracting Officer certifies that the award of a succeeding lease of ) is in the Government’s best interest and that this Justification is accurate and complete to the best of the VHA Lease Contracting Officer’s knowledge and belief.
