About this file
This is a Justification and Approval (J&A) document for Other Than Full and Open Competition (>SAT) filed by the Department of Veterans Affairs, VISN 8, C.W. Bill Young Veterans Administration Medical Center. The acquisition seeks to procure a fire protection system workstation upgrade for the facility's existing Johnson Controls fire alarm system through sole source acquisition, with an estimated cost of $852,215.73 under funds available in account 2237 516-26-2-5013-0019. The contracting activity justifies the sole source award under 41 USC §3304(a)(1), citing that only Johnson Controls is capable of providing a compatible workstation solution due to the proprietary nature of the existing fire protection infrastructure, including its software, hardware, and support services.
The contracting officer, David Wesley Hess, certifies that market research has confirmed no alternative manufacturers can provide a fully integrated workstation compatible with the existing system. Key justifications include the need for seamless compatibility with Johnson Controls hardware and software, Johnson Controls' specialized technical expertise in their proprietary systems, and the risk that utilizing third-party components would void existing warranties and support agreements. The document further notes that procuring from an alternative source would create significant risks including system incompatibility, increased integration costs, additional training requirements, and potential safety compromises to the fire alarm system. No other sources have expressed interest in the acquisition. The contracting officer recommends award to Johnson Controls, with approval signed and digitally executed on January 26, 2026.

1. Contracting Activity: Department of Veterans Affairs, VISN 8, C.W. Bill Young
Veterans Administration Medical Center Safety Department needs the installation and upgrade of the fire protection workstation upgrade for Bay Pine’s fire protection system. Funds are available under 2237 516-26-2-5013-0019, in the amount of $852,215.73 for the required services.
2. Nature and/or Description of the Action Being Approved: C.W. Bill Young Veterans Administration Medical Center (CWBYVAMC) facility requires procuring a fire protection system workstation for the Johnson Controls Fire Alarm System through a sole source acquisition. This document explains why the Johnson Controls workstation is the only suitable option for our needs, ensuring compliance with procurement regulations and securing the appropriate approvals.
3. Description of Supplies/Services Required to Meet the Agency’s Needs:
Upgrade of the existing fire alarm fiber communication network. The current infrastructure of our fire protection system has been designed and installed by Johnson Controls. 5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The fire protection system in the CWY Campus is a proprietary system.
The only manufacturer capable of installing this technology is Johnson Controls Inc.
The unique Qualifications are as followed:
• Compatibility: The fire protection system workstation must seamlessly integrate with Johnson Controls fire alarm hardware and software. Other manufacturers do not have the capability to provide a workstation that will function correctly with the proprietary systems already in place.
• Technical Expertise: Johnson Controls possesses specialized knowledge and expertise in their proprietary systems, ensuring that any updates, maintenance, and troubleshooting are conducted efficiently and effectively.
• Warranty and Support: Utilizing third-party components or workstations may void existing warranties and support agreements provided by Johnson Controls. This could lead to increased costs and possible system failures that are not covered under our current agreements.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as possible (including whether a notice was or will be publicized as required by RFO Part 5 and, if not, which exception under RFO Part 5 applies): The CO will continue to watch the market to ensure that there aren’t any changes in the market that would open the procurement for competition.
Until the time that Johnson Controls opens Certification to other entities the procurements, dealing with Johnson Controls’ proprietary system, will continue to be sole sourced to Johnson Controls.
7. Determination by the CO that the Anticipated Cost to the Government will be
Fair and Reasonable: There is enough past performance and prior contracts for this procurement to ensure that price reasonableness will be attained.
8. Description of the Market Research Conducted and the Results, or a
Statement of the Reasons Market Research Was Not Conducted: Market research has been conducted to identify potential alternatives to the Johnson Controls workstation. However, the research confirms that no other manufacturer can provide a compatible and fully integrated workstation solution for the existing fire alarm system. The reliance on Johnson Controls’ proprietary technology creates a significant impediment for other vendors to supply the necessary equipment.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition:
Failing to procure the fire protection system workstation from Johnson Controls would have several adverse effects:

System Incompatibility: The risk of incompatibility with the existing fire protection system increases significantly, potentially leading to operational failures or system malfunctions.
Increased Costs: Potential inclusion of third-party components could result in high integration costs, additional training requirements, and potential reconfiguration or replacement of current systems.
Safety Risks: Safety is paramount and ensuring a fully functional and integrated fire protection system is critical. Relying on non-proprietary workstations could compromise the reliability and effectiveness of the fire alarm system, putting lives and property at risk.
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:
None
11. A Statement of the Actions, if any, the Agency May Take to Remove or
Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Until Johnson Controls opens Certification to other entities there are no actions that the Agency can take to overcome the barriers to competition.
12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
Therefore, it is recommended that award be made to Johnson Controls.
