About this file

This document is a Justification and Approval (J&A) for Other Than Full and Open Competition (>SAT) for a sole source contract. The Department of Veterans Affairs, Network Contracting Office 8 (NCO 8) in Tampa, FL, is seeking a firm-fixed price contract, including a base year and four option years, for maintenance services on the Pyxis medication and supply dispensing equipment at the James A. Haley Veterans' Hospital.

CareFusion Solutions, LLC is the original equipment manufacturer (OEM) and the only vendor capable of providing the necessary repairs, parts, maintenance, and inspections for the Pyxis equipment. An RFI was posted on SAM.gov, but no other vendors responded, confirming CareFusion Solutions, LLC as the sole source. The estimated contract value is $1,840,440 for the base year plus four option years. The Contracting Officer has determined the pricing is fair and reasonable based on comparison to similar contracts at other VA medical centers. This contract will ensure the Pyxis equipment remains properly maintained and functional to support patient care.

Purchase Request# 673-25-1-048-0001.

2. Nature and/or Description of the Action Being Processed: The JAHVH Biomedical

Service Team has a procurement need for a New Firm-Fixed Price Contract, to include Base plus four (4) Option Years for Pyxis Medication & Supply Dispenser Maintenance Systems. No third party vendors can provide the necessary support services required to properly maintain this FDA-approved medical system.

3. Description of Services Required to Meet the Agency's Needs: The Biomedical services department needs to continue using the Pyxis services from the current sole source provider. BO Pyxis™ connected medication and supply management equipment helps to improve inventory visibility and address medication error challenges. This ensures that medications and supplies are available when and where they are needed across care settings. Medication and supply management can remove variability that impacts patient care and safety and improve operational efficiencies. CareFusion Solutions, LLC will provide repairs, parts, comprehensive scheduled maintenance, and inspections for all Pyxis equipment. Estimated Contract Value (including options):

5. Demonstration that the Contractor's Unique Qualifications or Nature of the

Acquisition Requires the Use of the Authority Cited Above (applicability of authority): CareFusion Solutions, LLC is the original equipment manufacturer (OEM) and holds proprietary rights for all the highly specialized equipment (Sole Source Letter in eCMS Briefcase). BD CareFusion Solutions, LLC is the only manufacturer that can provide the necessary full-service repairs and maintenance of all Pyxis medication dispensing systems owned by JAHVH. Improper Preventative Maintenance (PM) and repairs done by an unauthorized vendor can void any warranty that JAHVH currently has and can cause major delays in patient care if the units are not in operable status.

These Pyxis Medication & Supply Dispensers must be properly maintained to assure proper functionality and must be kept to OSHA Standards. This will reduce equipment downtime and avoid any further delays in patient care at JAHVH.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: On 9/13/2024, the Contracting Officer (CO) posted a Special Notice of Intentto Sole Source to CareFusion Solutions, LLC. This was to ensure that only one (1) source was capable of providing the necessary maintenance for Pyxis Medication & Supply Dispensers.

The notice (RFI# 36C24824Q1614) was successfully posted via www.SAM.gov (Contract Opportunities) to see if any vendor is capable of providing maintenance for Pyxis Medication & Supply Dispensers.

On 9/18/2024, the RFI closed, and zero (0) vendors responded, confirming that no other vendor is capable of providing maintenance for Pyxis Medication & Supply Dispensers.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The estimated costs for the Pyxis Medication & Supply Dispensers Maintenance are $1,840,440.00 for the base plus four (4) option years, as indicated in the IGCE. The Contracting Officer (CO) has determined that the expected cost to the Government will be fair and reasonable by comparing it with similar items procured within both VHA and the Federal Government. It has been confirmed that multiple VA Medical Centers currently hold active contracts for the same Pyxis Medication & Supply Dispensers Maintenance Service that JAHVH is requesting. The CO has verified that the current unit prices for each Pyxis Medication & Supply Dispenser under Contract# 36F79718D0454 - 36C24820F0003 at JAHVH VAMC align with the recent proposal presented to JAHVH. Several awards to VA Medical Centers from 7/30/18 - 2/22/2024 provide comparable cost data to use for the final fair and reasonable price determination with this procurement.
