About this file

This document is a Justification for Other Than Full and Open Competition (JOFOC) under Simplified Acquisition Procedures for a Nurse Call System procurement by the Department of Veterans Affairs, VISN 12, Captain James A. Lovell Federal Health Care Center (FHCC).

The FHCC is procuring an Ascom brand name Nurse Call System to replace its existing end-of-life system. Due to system compatibility and integration requirements with the current Ascom components, the FHCC is restricted to the Ascom product, which is being acquired through an unrestricted solicitation as a firm-fixed price purchase order. The procurement is estimated at $2,340,393 and will be delivered within 1 year. Market research identified no capable Service-Disabled Veteran-Owned Small Businesses or Veteran-Owned Small Businesses for this requirement under the applicable NAICS code. The anticipated cost is deemed fair and reasonable based on historical VA nurse call system purchases.

DEPARTMENT OF VETERANS AFFAIRS

SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN

COMMERCIAL ITEMS IN ACCORDANCE WITH FAR 13.5

Acquisition Plan Action ID:

1. Contracting Activity: Department of Veterans Affairs, VISN 12, Captain James A. Lovell

Federal Health Care Center (FHCC) has submitted for a Nurse Call System to the Great Lakes Acquisition Center (NCO12).

2. Nature and/or Description of the Action Being Processed: This procurement is for an Ascom brand name only nurse call system in accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2.

This Ascom nurse call system will be an Unrestricted solicitation and awarded as a Firm Fixed Priced purchase order. The Ascom brand is currently being utilized throughout the Captain James A. Lovell Federal Health Care Center.

3. Description of Supplies/Services Required to Meet the Agency’s Needs:

The Captain James A. Lovell FHCC is requesting to replace existing nurse call system. The current system is well-past life cycle, replacements parts are hard to find, and it is a critical infrastructure for the hospital.

Install is required in the following locations:

• VA James A. Lovell Nurse Call Ascom Backbone

• Building 134 1st, 2nd, 3rd Floor

• Building 133-2B, 133-2A, 133-3B, 133-3A, ER, ICU & Police Station

• Building 133-4 A/B

• Green Homes A, B, C & D 36C252-24-AP-2504 or 556-24-3-2993-0241

This acquisition is estimated at and will be delivered within 1 year after receipt of order.

4. Statutory Authority Permitting Restricted Competition:

FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement.

Competition is restricted on this procurement for the reason below:

(X) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements

( ) Unusual and Compelling Urgency ( ) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert

Services ( ) International Agreement ( ) Authorized or Required by Statute ( ) National Security ( ) Public Interest

Effective Date: 02/01/2022 Page 2 of 4

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

The existing nurse call system is a hybrid of EZCare and Ascom. EZCare is now part of Ascom. The Captain James A. Lovell FHCC has newer Ascom nurse call system components in about of the hospital that was replaced approximately four years ago in 131 2 A/C, 131 4A/4C and 134 3A due to new construction.

This procurement is estimated at which represents the backbone (main fiber optics/servers system) that is connected to the nurse call system needing replacement. If replacing all equipment with a different brand, the Government would need to replace all of the equipment that is past life expectancy plus the that is new (as of four years ago), estimated at approximately

Due to system compatibility and integration with the existing system, the Captain James A.

Lovell FHCC must upgrade the remaining Ascom nurse call system. This includes the new Ascom Unite system hardware and software to support nurse call integration with existing Ascom DECT mobile phones (wireless Ascom phones that is currently in use by the nursing staff) and logging and reporting software. The use of the Ascom nurse call system is essential to the Government’s requirements, precluding consideration of a product manufactured by another company.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

The Contract Specialist identified the Price List for GSA contract number GS-35F- 0662T (Ascom) which included Ascom “Participating Dealers” (authorized distributors).

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:

The government anticipates the cost to the government will be determined fair and reasonable through competition and comparison to historical purchases for nurse call systems by the VA.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:

This is a (Brand Name Only) procurement for nurse call system. Original Equipment Manufacturer (OEM) for this requirement is Ascom (US) INC. [H46MEMFTAD73] which is considered an Other Than Small Business (OTSB) per its System for Award Management (sam.gov) Representations and Certifications. A Veteran Small Business Certification (sba.gov) search to identify verified capable SDVOSBs and VOSBs, under NAICS 334290 search identified three-hundred and ninety-nine (399) SDVOSB and VOSB vendors. SBA – Dynamic Small Business Search of NAICS 334290 and keywords, “Ascom nurse call system” identified zero (0) SDVOSB vendors. Due to system compatibility and integration with the existing equipment, the Captain James A. Lovell FHCC requires Ascom equipment to replace the existing, end-of-life nurse call equipment.

This is a proposed unrestricted solicitation for brand name only Ascom Nurse call equipment.
