DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C249-22-AP-1805

1. Contracting Activity: Department of Veterans Affairs, VISN 09, Memphis Veterans Affairs Medical

Center, 614-23-1-5069-0008.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The

Memphis VA Medical Center has a requirement for toxic gas detection services to include testing and calibration of 4 methane and 8 carbon monoxide gas detectors located in the boiler plant of the hospital. The services must be conducted by a certified Sierra Monitor Corporation (SMC) inspector.

Carbon monoxide gas is an odorless and colorless gas that causes thousands of deaths each year in North America. Methane gas is equally as dangerous in that long term exposure can cause lasting cardiovascular, respiratory, and neurological problems. Burning natural gas produces nitrogen oxide, carbon monoxide and methane. It is imperative for the safety of patients and medical care providers to ensure toxic gas sensors are regularly tested and calibrated. This procurement is estimated at $27,660.00 (total contract value including options) as outlined below:

Base Year: 10/01/2022 – 09/30/2023 = $5,000.00

Option Year 1: 10/01/2023 – 09/30/2024 = $5,250.00

Option Year 2: 10/01/2024 – 09/30/2025 = $5,520.00

Option Year 3: 10/01/2025 – 09/30/2026 = $5,800.00

Option Year 4: 10/01/2026 – 09/30/2027 = $6,090.00

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: In summary, searches conducted in VIP and GSA returned a combined total of 49 potential SDVOSB vendors (29 VIP/20 GSA) it was unclear if any met the certification requirements needed to perform the requested services. An additional search conduced on the SBA website to identify small business vendors returned no results. Only one vendor responded to the sources sought notice which was posted for two weeks. Service-Disabled Veteran Owned Small Business, Reliable Monitoring Services stated they have the experience and certified staff needed to perform the service. A search conducted on the Federal Procurement Data System (FPDS) using Reliable Monitoring Services returned several contracts which have been awarded to the vendor within the past couple of years. Based on the lack of identified vendors having the necessary certification and lack of response from interest capable vendors to the sources sought notice, the VA Rule of Two cannot be met for the procurement. A sole source award to SDVOSB, Reliable Monitoring Services is recommended IAW VAAR 819.7007.

4. Description of market research conducted and results or statement why it was not conducted: A

VIP search conducted using NAICS code 811219 and key words Toxic Gas Detection returned 29 https://www.acquisition.gov/?q=/browse/far/13
