DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

VHAPM Part 813.106 Page 1 of 1 Original Date: 08/30/17 Revision 02 Eff Date: 03/31/2020

Acquisition Plan Action ID:__36C249-20-AP-2183________

1. Contracting Activity: Department of Veterans Affairs, VISN 09, Memphis VA Medical Center

NCO-9; PR: 614-20-3-560-0147.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

Qty: 2, Acist brand CVi Contrast Delivery Injector System

Qty: 1, CVi Cart

Item is for use in embolization procedures. Estimated Amount: $132,460.00

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

Pursuant to 38 U.S.C 8127(b), VAAR 813.106-70(b) and 15 USC 657f, COs may use other than full and open competition when awarding to SDVOSB and VOSB firms for procurements under the SAT. B2H Group has a contractual agreement with ACIST Medical Systems, Inc. (a large business) to be their sole distributor for ACIST products and services to the Department of Defense (DoD) and Department of Veterans Affairs (VA) only. Any direct quote from ACIST would offer products and services at a higher price than B2H Group’s offer and would be a violation of contract terms between B2H and ACIST. B2H is not authorized, however, to service ACIST equipment or train personnel on ACIST equipment.

4. Description of market research conducted and results or statement why it was not conducted:

Market research was conducted in accordance with VA Acquisition Regulation (VAAR) 810.001-70, VAAR 808.002, and 808.004-70. Market research also considered peer sources across VHA. This requirement is not on any mandatory contracts or BPAs. A Notice of Intent to Sole Source was posted from June 25, 2020 – July 7, 2020, with no response received. Phone call with ACIST Director of U.S. Sales, Tony Winter, confirmed the contractual relationship between B2H and ACIST.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
