6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
A Sources Sought announcement, 36C25923Q0167, was posted on Contract Opportunities on December 30, 2022, and closed on January 13, 2023. There were no responses to the source sought notice. A search of the Medicare.gov, SBA Small Business Dynamic Search, and Vendor Information Pages was conducted. A search was conducted using Medicare.gov nursing home compare website to find nursing homes in the Pueblo, Colorado area. There are nine (9) Community Nursing Homes within 25 miles of the zip code of 81004 in Pueblo, Colorado. While this shows there are nine (9) facilities within the same area code, Rock Canyon Healthcare, INC (d/b/a) Rock Canyon Respiratory and Rehabilitation Center is one of these nine (9). There is one other VA contracted facility in the remaining eight (8) facilities. The other seven (7) facilities have not been vetted through the VA process to establish them as VA contracted facilities nor have expressed interest in a contract. Also there are currently twenty (20) Veterans at the current facility and do not want to be relocated. They want to stay at that facility and be within close distance to their family. A search of VetBiz using zip code 81004 and the NAICS code 623110, resulted in 0 SDVOSBs/VOSBs. A search of the SBA Small Business Dynamic Search was conducted using the NAICS code 623110 and zip code 81004 and had zero results.
The CNH program requires the CNH Coordinator review the Medicare compare scores and provide a recommendation based on the current score. The CNH Coordinator reviewed the Medicare compare score for Rock Canyon Healthcare, INC (d/b/a) Rock Canyon Respiratory and Rehabilitation Center and determined a waiver was not required. As a part of the acquisition process, a CNH must provide a current state license, insurance, and a copy of the state inspection. These documents are provided to the CNH Program Coordinator for review and evaluation. The CNH Coordinator will either provide a recommendation to contract or state that the CNH did not receive a recommendation to contract. A redacted J&A will be posted on Contract Opportunities.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and
Reasonable:
The anticipated cost is anticipated to be considered fair and reasonable. This determination is based on Medicaid rates established by each state based on national average and also, the annual maximum allowable percentage that is published through the VHA Procurement Guide and VA Pulse by the VA Geriatrics and Extended Care Office. The annual maximum allowable percentage is applied to each Resource Utilization Groups (RUGS) IV category. The RUGS IV category identify the different levels of treatment. The add-on percentages are added to the basic Medicaid rate then applied to each RUGS IV category. The Medicaid rate and the VA add-on percentage make up the per diem rate paid for each Veteran. The line item structure will illustrate the different RUGS IV category, the add-on percentage, and the total per diem rate for each level of care. The facility will not offer services to ventilator-dependent patients as they are not equipped to do so. After conducting research on the
VHAPG Part 806.3 OFOC Page 3 of 4
Effective Date: 04/01/23 current Medicaid and RUGS IV rates, the Contracting Officer (CO) will evaluate the Offeror's rate to determine if the price per diem rates are fair and reasonable. If not, the Government will negotiate a change in the rate based on the allowable add-on percentage established by the Office of Geriatrics and Extended Care. The add-on percentages do not change through the life of the contract.
