DEPARTMENT OF VETERANS AFFAIRS

Justification and Approval (J&A) For

Other Than Full and Open Competition (>SAT)

Acquisition Plan Action ID: 36C257-26-AP-4316

1. Contracting Activity:

The Department of Veterans Affairs (VA), Network Contracting Office (NCO) 17, located at 11495 Turner Road, El Paso, TX 79936, intends to award a sole-source contract under this Justification for Other Than Full and Open Competition for the South Texas Veterans Health Care System (STVHCS), 7400 Merton Minter Memorial St., San Antonio, TX 78229. The purchase request number is 671-26-4-092-0476.

2. Nature and/or Description of the Action Being Approved:

This procurement is an urgent, short-term requirement necessary to maintain uninterrupted Imaging Service operations at STVHCS. Immediate action is required to ensure continuity of patient care, as Imaging Services cannot function safely or effectively without qualified radiology staff. A fully trained, credentialed teleradiology provider is needed to perform these services without onboarding delay. This short-term bridge action will sustain patient care while the facility completes a competitive acquisition for long-term services.

3. Description of Supplies/Services Required to Meet the Agency's Needs:

STVHCS requires board-certified radiologist support during weekdays, weekends, afterhours, and holidays to provide timely interpretation of Imaging procedures, including emergent studies. Failure to secure immediate coverage would create unacceptable patient safety risk and disrupt Imaging operations.

A short-term fixed-price contract is required to ensure continuous availability of qualified radiologists until a competitive solicitation can be executed. VetMed Group LLC is the only contractor able to provide immediate coverage due to its existing VA credentials, training, and experience providing identical services at other VA facilities. The estimated value for the six-month base period is $786,750.00.

4. Statutory Authority Permitting Other than Full and Open Competition:

Unusual and Compelling Urgency per 41 USC §3304(a)(2), as implemented by Revolutionary FAR Overhaul (RFO) 6.103-2.

5. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

Immediate availability of qualified teleradiology support is required to prevent risks to patient safety and maintain continuity of Imaging services. VetMed Group LLC personnel are already performing similar services at other VA facilities and meet all applicable VA, CDC, Department of Health, and Joint Commission competency requirements. VetMed Group LLC can begin performance with minimal delay, making it the only practical source capable of meeting the Government's urgent need within the required timeframe.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as possible (including whether a notice was or will be publicized as required by RFO Part 5 and, if not, which exception under RFO Part 5 applies):

This requirement meets the criteria for 41 U.S.C. § 3304(a)(2), Unusual and Compelling Urgency, implemented through RFO 6.103-2. Teleradiology coverage is indispensable to patient care, and any lapse would pose unacceptable clinical risk.

A quick search of Adds-Up showed 45 hits for teleradiology with VetMed Group LLC having 43 of these contracts/task orders.

Although urgency limited the time available, the Government requested and considered capability information from multiple contractors, and only VetMed Group LLC demonstrated the immediate capability to perform without delay.

VetMed Group LLC is uniquely qualified because its personnel are already fully credentialed and trained in VA-specific protocols, and actively performing identical services at multiple VA sites.

No other contractor can provide staff with immediate availability and required competencies within the time available. Attempting to compete this requirement or onboard an alternative source would result in unacceptable delay and potential patient harm. VetMed Group LLC is therefore the only responsible source capable of meeting the Government's need within the required timeframe.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable:

Market research was conducted, including a review of GSA Schedule pricing and historical procurement data for comparable teleradiology services. The proposed price aligns with recent Government acquisitions of similar scope and complexity. This consistency, along with the availability of multiple independent price points, supports the determination that the anticipated cost is fair and reasonable.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:

Due to the unusual and compelling urgency associated with maintaining uninterrupted radiology services, conducting extensive market research would have caused unacceptable delays and posed significant risks to patient care. This requirement meets the criteria for 41 U.S.C. § 3304(a)(2), Unusual and Compelling Urgency, implemented through RFO 6.103-2. Teleradiology coverage is indispensable to patient care, and any lapse would pose unacceptable clinical risk.

Limited market research was performed to the extent practicable. A quick search of Adds Up identified 45 teleradiology related awards, of which VetMed Group LLC held 43, demonstrating substantial experience providing these services across VA facilities.

Based on these results, VetMed Group LLC is the only vendor identified with proven capability, required credentials, and the ability to begin performance immediately.

Barriers to Competition before Making subsequent acquisitions for the supplies or services required:

The agency intends to conduct a competitive acquisition for long-term teleradiology services. A long-term requirements package is currently being worked on by the COR and is currently on the approval phase before submitting the package to contracting. The anticipated award date will be March 01, 2027.
