3. Unique characteristics that limit availability to only one source, with the reason no other services can be used: 41 U.S.C. 3304(a)(5), 38 U.S.C. 8127(c), as implemented by FAR 6.302-5 (Authorized or Required by Statute). Contracting Officers may use the non-competitive (sole source) procedures authorized in VAAR 819.7007 Sole source awards to a verified service-disabled veteran-owned small business or 819.7008 Sole source awards to a verified veteran-owned small business up to $5,000,000.

4. Description of market research conducted and results or statement why it was not conducted:

The Contracting Officer conducted market research and identified five Federal Supply Schedule (FSS) vendors who might be able to provide immediate RNs to meet the needs of Tomah VAMC. A Request for Quotes (RFQ) was issued on issued December 11, 2020 for similar services that were required at the Jesse Brown VAMC. Responses were received from two SDVOSB vendors of the 17 that were included in the selected category (621-025 Nurses). The Contracting Officer used that list of providers to seek services for Tomah VAMC’s requirement. Ghost RX was only able to provide one RN in response to the RFQ. Another SDVOSB vendor responded communicating its interest but was not able to provide candidates. The Contracting Officer will continue to seek the services of SDVOSB vendors to meet the remaining needs of the Tomah VAMC.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
