The VA Medical Center in Nashville, TN has a need for the Philips Azurion 7 C20 Catalyst system, an integrated Cath Lab suite that provides an image-guided therapy solution for diagnosing and treating patients with coronary and valvular heart diseases. The estimated price for this requirement is $1,355,272.80. The justification cites the urgent need to replace the current end-of-life equipment before it becomes unsupported, which would require referring patients to outside care and result in a substantial financial loss to the government. DEPARTMENT OF VETERAN AFFAIRS

Office of Acquisition and Logistics

National Acquisition Center P.O. Box 76

Hines, IL 60141

Justification for an Exception to Fair Opportunity FAR 16.505(b)(2)(i)(A) – Urgency

(1) Identification of the agency and the contracting activity.

This Justification for an Exception to Fair Opportunity is on behalf of VISN 9 Nashville VA Medical Center and will be executed by the Department of Veterans Affairs (VA) National Acquisition Center (NAC-36A797) located in Hines, IL.

(2) Nature and/or description of the action being approved.

The activity proposes the issuance of an urgent delivery order against Indefinite Delivery Indefinite Quantity (IDIQ) contract VA797H-17-D-0022 awarded to Philips North America, LLC for the fulfillment of Cath Lab hardware, installation, and required software.

(3) A description of the supplies or services required to meet the agency’s needs, including the estimated value.

Nashville VA Medical Center has identified the commercial product “Philips Azurion 7 C20 Catalyst system” to meet the Agency’s need. The agency needs an integrated Cath Lab suite that performs deepen insight image -guided therapy solution for the purposes of diagnosing and treating patients with coronary and valvular heart diseases. The estimated price for this requirement is $1,355,272.80.

(4) An identification of the exception to fair opportunity (see 16.505(b) (2)) and the supporting rationale, including a demonstration that the proposed contractor’s unique qualification or the nature of the acquisition requires use of the exception cited. If the contracting officer uses the logical follow-on exception, the rationale shall describe why the relationship between the initial order and the follow-on is logical (e.g. in terms of scope, period of performance, or value).

Nashville VA Medical Center’s need for the Philips Azurion 7 C20 Catalyst system is of such urgency that providing fair opportunity will result in unacceptable delays to patient care and a substantial financial loss to the government. In this regard, competing this requirement through the consolidation process would unduly impact the station’s ability to provide patient care, as the station will have to wait one year or more to receive the needed equipment.

Time is of the essence as the current equipment is rapidly nearing end-of-life. It will no longer be supported by the OEM’s maintenance contract after December 31, 2024. If the current system is in use in 2025, replacement parts will not be available. If the system were to fail during that time, Veterans with coronary and valvular heart diseases will need to be referred to medical care in the community. Without this updated Azurion 7 C20 Catalyst system, the Nashville VA Medical Center will not be able to provide mission essential services on site. As such, this requirement is considered urgent and meets the exception to fair opportunity pursuant to FAR 16.505(b)(2)(i)(A) – Urgency.
