About this file
This document is a Justification for an Exception to Fair Opportunity for a sole source delivery order against Indefinite Delivery Indefinite Quantity (IDIQ) contract 36H79719D0014 awarded to Varian Medical Systems. The Department of Veterans Affairs (VA) National Acquisition Center proposes to issue a sole source delivery order to Varian for the fulfillment of a linear accelerator with required installation, hardware, software, and training. The linear accelerator, a Varian EDGE Base System HD120 MLC, is needed to meet the specific requirements of the Albany VA Medical Center's Stereotactic Body Radiotherapy program, which treats small lesions. The accelerator must integrate with the station's existing Varian equipment, fit within the existing vault, and include a non-invasive triggered imaging monitoring system. The estimated price for this requirement is $8,267,426.00. The justification cites Varian's unique qualifications and the need for integrative functionality as the rationale for the sole source procurement.

DEPARTMENT OF VETERAN AFFAIRS
Office of Acquisition and Logistics
National Acquisition Center P.O. Box 76
Hines, IL 60141
Justification for an Exception to Fair Opportunity FAR 16.505(b)(2)(i)(B) – Only one capable source
(1) Identification of the agency and the contracting activity.
This Justification for an Exception to Fair Opportunity is on behalf of VISN 2 Albany VA Medical Center and will be executed by the Department of Veterans Affairs (VA) National Acquisition Center (NAC-36A797) located in Hines, IL.
(2) Nature and/or description of the action being approved.
The activity proposes the issuance of a sole source delivery order against Indefinite Delivery Indefinite Quantity (IDIQ) contract 36H79719D0014 awarded to Varian Medical Systems for the fulfillment of a linear accelerator with required installation, hardware, software, and training.
(3) A description of the supplies or services required to meet the agency’s needs, including the estimated value.
Albany VA Medical Center has identified the commercial product “Varian EDGE Base System HD120 MLC” to meet the agency’s need. The agency needs a highly specialized linear accelerator to treat very small lesions during Stereotactic Radiosurgery (SRS) and Stereotactic Body Radiotherapy (SBRT) treatments. The equipment must contain High- Definition Multi-Leaf Collimators (MLCs), fit within the existing vault at the station, work in a closed loop environment, contain a non-invasive triggered imaging monitoring system for the station’s Stereotactic Body Radiotherapy program, and integrate with the current Varian accelerator. The estimated price for this requirement is $8,267,426.00.
(4) An identification of the exception to fair opportunity (see 16.505(b) (2)) and the supporting rationale, including a demonstration that the proposed contractor’s unique qualification or the nature of the acquisition requires use of the exception cited. If the contracting officer uses the logical follow-on exception, the rationale shall describe why the relationship between the initial order and the follow-on is logical (e.g. in terms of scope, period of performance, or value).
The Varian Edge Linear Accelerator is vital as it is uniquely qualified to meet the station’s needs.
Albany VA Medical Center has a comprehensive Stereotactic Body Radiotherapy program that treats Brain, Liver, Prostate and Lung diseases. The existing Varian linear accelerator is a highly specialized machine that delivers to a very small tumor. The Varian EDGE Base System HD120 MLC can seamlessly integrate with the station’s existing equipment.
No other vendor’s linear accelerator has the integrative functionality required for the Stereotactic Radiosurgery and Stereotactic Body Radiotherapy treatments procedures utilized at the station. Only Varian’s accelerator can to the existent TrueBeam Varian accelerator. This feature is crucial as it will allow the station to have a contingency plan for down time on both machines.
