About this file
This document is a Justification and Approval (J&A) for a sole source contract to a Service-Disabled Veteran-Owned Small Business (SDVOSB). The Department of Veterans Affairs, specifically the Overton Brooks VA Medical Center in Shreveport, Louisiana, requires a renovation of Building 42 to serve as a new Pharmacy Cache facility. The project involves completely renovating a 1,800 square foot modular building with a 290-calendar day performance period. Blue Cord Design and Construction LLC has been identified as the sole source contractor due to their renovation expertise, knowledge of the facility, and proven performance record.
The contract will be awarded under VAAR 819.7008 for SDVOSB sole source awards, with a firm-fixed price. The Contracting Officer determined that pursuing full and open competition would create unacceptable delays. The total market research identified 3,939 SDVOSB contractors in the relevant NAICS code, but the urgency of the project justifies the sole source approach. The procurement is a one-time requirement, and the J&A document includes approvals from multiple levels of VA contracting leadership, including the Contracting Officer, Director of Contracting, and the Head of Contracting Activity.

VHAPG Part 819.7008/7009 Sole Source Awards to SDVOSB/VOSB Revision: 04 Effective Date: 11/15/2024
DEPARTMENT OF VETERANS AFFAIRS
Justification and Approval (J&A) For
Other Than Full and Open Competition
Acquisition Plan Action ID: 36C256-25-AP-1527
1. Contracting Activity:
Network Contracting Office (NCO) 16 Department of Veterans Affairs, VISN 16 Overton Brooks VA Medical Center Shreveport, Louisiana 2237#: 629-24-3-690-0368
2. Nature and/or Description of the Action Being Approved:
This procurement is a new, one time, firm-fixed price requirement for renovation of the building 42 pharmacy cache for Overton Brooks VA Medical Center (OBVAMC) in Shreveport LA 71101.
3. Description of Supplies/Services Required to Meet the Agency’s Needs:
Overton Brooks VAMC has a requirement to completely renovate Building 42, a modular building, to be used as the new Pharmacy Cache facility, on the North side of Building 1, OBVAMC in Shreveport, LA. The Pharmacy Design parameters call for 2,000 square feet for the Pharmacy Cache, this building’s total square footage is 1,800 square feet, no additional square footage will be added. The period of performance for this project is 290 calendar days.
4. Statutory Authority Permitting Other than Full and Open Competition: 41 USC
§3304(a)(5), 38 U.S. Code § 8127(c), as implemented by FAR 6.302-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7008 (DEVIATION) or VAAR 819.7009 (DEVIATION)- up to $5,000,000.
Check the specific VAAR clause used below:
(X ) 819.7008 Sole source awards to a certified service-disabled veteran-owned small business; or ( ) 819.7009 Sole source awards to a certified veteran-owned small business
5. Demonstration that the Contractor’s Unique Qualifications and/or Nature of the
Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
It has been determined that this requirement shall be set aside for an other-than-full and open competition in accordance with FAR 6.302-5(b)(6).
The proposed award falls squarely under this authority. In this case, the selected SDVOSB vendor, Blue Cord Design and Construction LLC, has been identified as the only responsible https://www.va.gov/oal/library/vaar/vaar819.asp#8197008 https://www.va.gov/oal/library/vaar/vaar819.asp#8197009
Revision: 04 source capable of delivering the required solution within the required timeframes. Attempting to pursue a full and open competition or alternate procurement strategy would create unacceptable delays and jeopardize the VA’s ability to execute on its promised outcomes.
Blue Cord Design and Construction LLC, a verified Service-Disabled Veteran-Owned Small Business (SDVOSB), has demonstrated renovation expertise and possesses extensive knowledge of the OBVAMC. They meet the eligibility criteria outlined in VAAR 819.7003 and have a proven track record of responsible performance. Their pricing is consistently found to be fair and reasonable. Additionally, Blue Cord's leadership team is highly responsive and delivers information in a timely manner. Based on these factors, it is determined that they are the preferred contractor to be selected for this requirement.
Accordingly, use of a sole source award under the VAAR “Veterans First” authority is both legally permissible and operationally necessary. It ensures that the Department fulfills its obligation to veteran-owned businesses while simultaneously responding with agility to evolving priorities. This approach represents the most efficient and mission-aligned path to meet urgent requirements without disruption or delay.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable, including whether a notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under FAR 5.202 applies:
Given the urgency to make the award within 30 days, the CO has determined that a sole source award to a Service-Disabled Veteran-Owned Small Business (SDVOSB), in accordance with VAAR 819.7008, is both legally permissible and operationally necessary.
Although there are multiple potential sources available, the need for expedited award justifies this approach. This Justification and Approval (JA) shall be published on SAM.gov within 14 days of the award and will remain posted for a minimum of 30 days.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and
Reasonable:
It is anticipated that Blue Cord will submit pricing that can be determined fair and reasonable based on historical pricing data. To ensure the price is fair and reasonable, the CO will perform a price analysis by comparing the proposed pricing to the Independent Government Cost Estimate (IGCE) in accordance with FAR 15.404-1(b)(2)(v). Additionally, the CO may engage in price negotiations in accordance with FAR 15.405 to ensure fair and reasonable pricing is achieved.
8. Description of the Market Research Conducted and the Results, or a Statement of the
Reasons Market Research Was Not Conducted:
There are 3,939 SDVOSB contractors that were identified for NAICS code 236220. Due to the timeframe for award, it has been determined that this requirement is best met with a sole-source award to a verified SDVOSB. Blue Cord meets the eligibility criteria outlined in VAAR 819.7003 for award.
