DEPARTMENT OF VETERANS AFFAIRS
SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL
ITEMS IN ACCORDANCE WITH FAR 13.5
Acquisition Plan Action ID: 36C259-20-AP-4701
1. Contracting Activity: Department of Veterans Affairs, VISN 19, Salt Lake City Health Care System, Salt Lake City VA Medical Center, 500 Foothill Blvd, Salt Lake City UT 84148. Network Contracting Office 19, 6162 South Willow Drive Suite 300 Greenwood Village CO 80111.
2. Nature and/or Description of the Action Being Processed: This procurement is for Perfusion Services in accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR
13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2. The Perfusion services will be awarded as a follow-on Firm Fixed Price Indefinite Delivery Indefinite Quantity contract.
3. Description of Supplies/Services Required to Meet the Agency’s Needs: Perfusion Services consists of 241 hours of scheduled operation room cases and 5000 hours of on call and standby cases. The total contract value is $272,919.18. The period of performance is from 10/1/2020 – 3/31/2021.
Options are not included in this requirement.
4. Statutory Authority Permitting Restricted Competition:
FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): This procurement is for Perfusion Services in accordance with FAR 6.303-5 Authorized or required by statute, Public Law 109-461 Veteran's First. The incumbent contractor, Posterity Group LLC, is a Service-Disabled Veteran Owned Small Business with the capability to provide Perfusion services. Posterity Group LLC has an established relationship with the medical center surgeons. The team atmosphere between a surgeon and perfusionist is vital for successful surgical outcomes. The medical center expects services to be performed by Government hired employees after this performance period.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: A sources sought notice was not posted for this effort as it will be a follow-on award for continued service for 6 months. If services are required after this 6-month period, a competitive solicitation will be issued to SDVOSB with capability to provide services.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and
Reasonable: The proposed price will be evaluated in accordance with FAR 13.106-3 (a)(2)(i) Market Research, (a)(2)(ii) Comparison of the proposed price with prices found reasonable on previous purchases,(a)(2)(vi) Comparison to an Independent Government Estimate.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons
Market Research Was Not Conducted: Market Research on GSA reflects two SDVOSB contractors;
Caduceus Healthcare Inc. and Global Dynamics, LLC under schedule 621-036 Perfusionist/Perfusion Technologist. A VIP search under NAICS 621399 Offices of All Other Miscellaneous Health Practitioners reflects 177 SDVOSBs. A VIP Key word search of “Perfusion” resulted in 1 SDVOSB, Posterity Group LLC.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition: None.
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Posterity Group LLC
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: If services are required in the future, the requirement will be solicited to SDVOSBs with capability to provide services.
12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona
Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
