About this file

This is a Justification and Approval (J&A) document for other than full and open competition issued by the Department of Veterans Affairs for the renewal of Mobile Medical Unit 4 (MMU4) maintenance services.

The Orlando VA Healthcare System (OVAHCS) Emergency Management Service seeks to renew on-site inspection and preventive maintenance services for MMU4, a critical deployable asset used for emergency response operations within VISN 8. The current contract with incumbent Kapcook Enterprises expires February 28, 2026, and the proposed action includes a base period from March 1, 2026 through February 28, 2027, with four optional one-year renewals. The total estimated value is $500,000. Services will be performed at eight locations where the vehicle may be stationed and include compliance with OSHA safety standards and National Institute for Automotive Service Excellence (ASE) standards. The contractor must provide all personnel, equipment, supplies, facilities, tools, materials, and supervision necessary to maintain the MMU according to manufacturer specifications and maintenance schedules.

The VA justified the sole-source award to Kapcook Enterprises under 41 USC §3304(a)(5) (Authorized or Required by Statute), citing the contractor's unique qualifications as an SBA-verified Service-Disabled Veteran-Owned Small Business (SDVOSB) with ASE-certified technicians specializing in medium/heavy truck repair and integrated HVAC and generator systems. Market research and a notice of intent to sole source issued February 4, 2026 (with responses due February 11, 2026) yielded no competing bids or challenges. The CO determined anticipated pricing representing a 5% annual escalation from the prior contract year to be fair and reasonable. The J&A was certified by Jeffery E. Jackson (Emergency Management Specialist) on February 18, 2025, the Contracting Officer on February 24, 2026, and approved by the Supervisory Contracting Officer on February 25, 2026.

( ) (7) Public Interest per 41 USC §3304(a)(7) as implemented by RFO 6.103-7;

6. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

Kapcook Enterprises is an SBA verified SDVOSB concern that offers Automotive Service Excellence (ASC) certified technicians specializing in medium/heavy truck repair as well as skills in managing HVAC systems, generators, and other essential equipment integrated with the mobile unit. Kapcook also offers on-site service at the VA locations whereas other vendors require the vehicle to be delivered and dropped off at a maintenance shop for work. Kapcook Enterprises has a proven track record of effectiveness and reliability providing identical services and has met/exceeded standards of past requirements, reference 36C24825P0718.

7. Description of Efforts Made to ensure that offers are solicited from as many potential sources as possible (including whether a notice was or will be publicized as required by RFO Part 5 and, if not, which exception under RFO Part 5 applies):

The same requirement was acquired in FY25 and awarded on 36C24825P0718.

Market Research determined that the requirement was suitable for SDVOSB Set- Aside and was solicited as such. Two (2) quotes were received in response to the RFQ. Based on the quotes received, the Contracting Officer determined that neither quote addressed the unique complexities required to maintain the subject MMU.

Consequently, no award was made.

A new solicitation was issued as a Small Business Set-Aside. One (1) quote was received in response from Kapcook Enterprises LLC, which is an SDVOSB. The quote from Kapcook was found to meet all technical requirements and the price was determined fair and reasonable. Kapcook has performed at a satisfactory performance level for the duration of the contract.

For the current requirement, a notice of Intent to Sole Source was issued on 02/04/2026 with responses due on 02/11/2026 (36C24826Q0306). No responses or challenges were received.

All Market Research and contemporaneous knowledge of the market indicates that Kapcook Enterprises remains the only source capable of providing the services required to maintain operational readiness of MMU4.

8. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: Preliminary conversations suggest that the prices to be quoted by Kapcook Enterprises for this requirement will represent a 5% escalation from the previous (FY25) contract, with a 5% escalation for each concurrent option.

Both the Contracting Officer and the Mission Partner expected a higher escalation in the range of 10 to 12%. It is therefore anticipated that the prices to be quoted by Kapcook Enterprises for this requirement will be fair and reasonable.

9. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:

As described in Section 6 above, market research, in accordance with RFO Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties.

10. Any Other Facts Supporting the Use of Other than Full and Open Competition:

Kapcook has clearly demonstrated that this firm is capable of doing so and has performed successfully under the current contract.

No other firm has expressed capability or interest in performing the services required. Kapcook Enterprises, LLC is a certified SDVOSB. Award can be made under FAR 19.106-3 Sole source awards, invoking the authority of 41 USC §3304(a)(5) as implemented by RFO 6.103-5.
