About this file

This document is a Sole Source Justification for a Simplified Acquisition Procedure (SAP) for an emergency water line repair at the VA Black Hills Health Care System's Hot Springs Medical Center. The urgent project involves replacing a 6" water main serving Building 43's Laundry Department, with an estimated cost of $36,300. Due to the critical nature of the repair and potential operational disruptions, the VA determined Gardner Structures, a Native American Owned Small Business located in Hot Springs, SD, as the sole source contractor.

The justification highlights the immediate need to restore water service, prevent potential patient care and staffing impacts, and avoid additional outsourcing costs. Market research conducted through VetCert revealed no local Service-Disabled Veteran-Owned Small Businesses (SDVOSB) capable of immediate response. The contract was awarded to Gardner Structures on 2/14/2025 for $36,734.40 under solicitation number 36C26325P0479, with the work involving water line replacement, asphalt removal, excavation, and infrastructure restoration at the Hot Springs VA Medical Center.

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C263-25-AP-1788

1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office 23 (NCO23), Construction Team 2 is responsible for this action. The requesting activity is VISN 23, VA Black Hills Health Care System (VABHHCS) at the Hot Springs VA Medical Center (VAMC), Facilities Management Engineering Department, 500 North, Fifth Street, Hot Springs, SD 57747.

Purchase Request Number (2237): 568-25-2-9951-0048

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

VABHHCS has an emergent need for repair/replacement of a 6” water line serving Building 43, Laundry Building at the Hot Springs VAMC. The main water line broke and is leaving in the roadway between Building 10 and 43. The project will consist of removing and replacing the water line from the location of the break to the shutoff valve behind an existing retaining wall, asphalt removal, excavation, supporting of retaining wall while digging to expose the leak, backfill, flowable fill under the retaining wall and concrete replacement at a warmer date. The estimated cost of this project is $36,300.00.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: Due to the urgent matter of this need, competition for pricing for this requirement was unable to be completed. Buildng 43 at the Hot Springs VAMC houses the Laundry Department for the facilty. Due to the water main break, Building 43 and the entire Laundry Department water source has been isolated and shut off and is currently without water. A delay in award of a contract could result in longer and further impacts to the operations of the campus. A delay in award of a contract could not only result not having the proper linens available for patients and staff but could also create other financial burdens to the Government by needing to outsource the laundry.

The work to repair and/or replace the main water line for Building 43 needs to be performed immediately in order to restore water to the building; therefore, a sole source requirement is in the best interest of the Government to be able to make an award to a contractor who can meet the immediate need of services associated with this requirement, and who has the knowledge of the Hot Springs VAMC and its water line systems involved..

It is in the Government’s best interest to award a sole source contract to a vendor that can respond immediately at a fair and reasonable price. Gardner Structures is the only contractor found that can meet all of these needs under this urgent and compelling requirement https://www.acquisition.gov/?q=/browse/far/13

4. Description of market research conducted and results or statement why it was not conducted:

Minimal market research was conducted due to uniqueness of this requirement. A VetCert query was conducted for a local SDVOSB that would have the capability to respond to this requirement immediately. While VetCert shows that there are SDVOSB’s under the appropriate NAICS, none are local to the remote location of Hot Springs, SD. Goven these results, there is not two or more SDVOSBs or VOSBs capable of performing the work, and/or likely to submit an offer/quote at a fair and reasonable price that offers best value to the Government.

As stated previously, immediate action needed to be taken by a contractor. The selected contractor has been involved in other domestic water line replacement on the Hot Springs VAMC campus and they have knowledge of the facilities water line system. Additional market research was conducted to ensuring that Gardner Structures, who is a Native American Owned Small Business located in Hot Springs, SD as to their availability to an immediate response. Gardner Structures confirmed that they would be able to start work without delay.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
