JUSTIFICATION FOR SOLE SOURCE AWARDS IAW FAR 13.5 - SIMPLIFIED

PROCEDURES FOR CERTAIN COMMERCIAL ITEMS

(OVER SIMPLIFIED ACQUISITION THRESHOLD BUT NOT EXCEEDING $7.5 Million)

1. Contracting Activity: Department of Veterans Affairs (VA) Office of Procurement, Acquisitions, and Logistics (OPAL) Strategic Acquisition Center (SAC) 5202 Presidents Court, Suite 103 Frederick, MD 21703

2. Description of Action:

The proposed sole source action is for a new one-year and two one-year options firm-fixed price (FFP) effort for FDM 3D printed support removal machine (VORSA), Vibratory polisher (RADOR), and Solidworks CAD software for Richmond VA Medical Center (RVAMC) and VA Puget Sound Health Care System (VPSHCS).

3. Description of Supplies or Services:

The proposed action is to provide Richmond VA Medical Center (RVAMC) and VA Puget Sound Health Care System (VPSHCS) an FDM 3D printed support removal machine (VORSA), Vibratory polisher (RADOR), Solidworks CAD software, and applicable preventative maintenance and software update services in accordance with the following schedule:

Supplies:

i) Base Requirement -

(1) FDM 3D printed support removal machine (VORSA) – Richmond VA Medical Center

(2) Vibratory polisher (RADOR) - Richmond VA Medical Center

(3) CAD Software: Solidworks Professional Network License

(a) 1 seat at Richmond VA Medical Center

(b) 3 seats at Seattle VA Medical Center

ii) Options Requirement

(1) Additional Solidworks Professional Network License

(2) Solidworks Network Professional Plastic module

(3) FDM 3D printed support removal machine (VORSA)

(4) Vibratory polisher (RADOR)

Services:

iii) Options Requirement

(1) The contractor shall provide all labor, personnel, equipment, tools, materials, supervision and other items necessary to provide annual preventive maintenance and software support remotely and on site for the VORSA machine, RADOR machine, and Solidworks CAD Software located at the Central Virginia VA Health Care System (CVHCS) and the Seattle VA Medical Center as defined in the Statement of Work (SOW).

The estimated period of performance is September 30, 2021-September 29, 2022;

with two 1-year option periods The total estimated value including 2 option periods is $255,004.31.

4. Statutory Authority: FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

(X) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements

5. Rationale Supporting Use of Authority Cited Above:

Solidworks is the standard CAD software already in use at the Seattle and Richmond VA Medical Centers. It is essential that the software purchased will be compatible with the current highly specialized systems in place.Trimech Solutions, LLC is the authorized reseller in the Richmond region for Solidworks products (Exhibit 1). TriMech is also the authorized sole source provider of PostProcess technology to the Richmond VAMC (Exhibit 2). PostProcess Technologies, Inc. is the original equipment manufacturer (OEM) of VORSA and RADOR equipment and services. The Richmond VA Medical Center already has RADOR systems in place, thus it is essential to purchase the same equipment (RADOR and VORSA) to be compatible with software and consumables for these systems. TriMech is able to provide these items and services to the Seattle VA Medical Center through a Multi- Reseller Usage Agreement (Exhibit 3). TriMech Solutions, LLC is the only identified authorized vendor able to provide all of the necessary items and services.

6. Efforts to Obtain Competition:

Market research was conducted, details of which are in the market research section of this document. This effort did not yield any additional sources that can meet the Government’s requirements. There is no competition anticipated for this acquisition.

Additionally, the proposed action will be synopsized on the Federal Business Opportunities Page in accordance with FAR PART 5.

7. Actions to Increase Competition:

The Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed.

8. Market Research:

In accordance with VA Procurement Policy Memorandum (PPM) (2016-05), in developing the acquisition strategy for any contract, the contracting officer shall take into consideration the impact of the VA Rule of Two and the best method of successfully implementing that requirement. On July 29, 2021, the vendor portal was searched via Home · VetBiz Portal (va.gov), using NAICS codes 511210, 541519, and the key word SolidWorks. A single SDVOSB vendor was revealed (Exhibit 4). To identify available small businesses, on July 29, 2021 the Dynamic Small Business Search tool was searched via SBA - Dynamic Small Business Search, using NAICS codes 511210, 541519, and the key word SolidWorks. Sixteen vendors were revealed (Exhibit 5). On July 29, 2021, a Request for Information to determine capability was sent to all identified small business vendors from VetBiz and the SBA Search Tool allowing for responses until August 3, 2021 (Exhibit 6). There were NO RESPONSES. An other than small business vendor was identified as the sole source provider for the PostProcess items, an authorized reseller for SolidWorks, and able to provide all necessary items and services in both locations: TriMech Solutions, LLC. An Intent to Sole Source was posted to Contract Opportunities on August 16, 2021 allowing vendors to respond with capabilities until August 19, 2021 (Exhibit 7). There were NO RESPONSES. These efforts did not yield any additional sources that can meet the Government's requirements. There is no competition anticipated for this acquisition. Market research supports a sole source acquisition in accordance with FAR13.5.

9. Other Facts:

None.

10. Technical and Requirements Certification: I certify that the supporting data under my cognizance, which are included in this justification, are accurate and complete to the best of my knowledge and belief.

11. Fair and Reasonable Cost Determination: I hereby determine that the anticipated price to the Government for this contract action will be fair and reasonable based on a comparison of current contract pricing, past proposal submissions (if available), and other information made available utilizing price analysis for the above specified SolidWorks, VORSA, and RADOR items.

12. Procuring Contracting Officer Certification: For a proposed contract exceeding the simplified acquisition threshold but not greater than $7.5 million, the contracting officer’s certification required by FAR13.501(a)(2)(i) will serve as approval. I certify that this justification is accurate and complete to the best of my knowledge and belief. As this contract action does not exceed $7.5 million, the certification below required by FAR 13.501(a)(2)(i) serves as approval.
