4. Demonstration that the Contractor’s Unique Qualifications or Nature of the

Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

The proposed contractor, ZMED, is physically located close to the facility to be able to come to the medical center, diagnose the failure of the eqiment to determine the extend of the repairs needed. This removed any requirement to ship the equipment to another site and satisfies the agency requirement of the one (1) day response to pick up to diagnose and repair and provide a loaner scope within 48 hours of request. The proposed contractor being local to the facility removes extra time in having to have techs dispatched and removed any requirement to ship to and from the facility saving the government time and money.

5. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Through market research, it was found that the proposed contractor has been the lowest bidder on multiple awards as well as this proposed contractor is the only one that is physically close to the facility and is able to meet the one (1) day turn around for pick up of broken equipment. Due to this fact we will be proposing this be done as a sole source. As this is a one year period of performance we will look to solicit this contract to other vendors if it is deterimined that any other viable sources exist.

6. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable: Fair and reasonable pricing will be based on previous contract pricing and the

Independent Government Cost Estimate (IGCE).

Reasons Market Research Was Not Conducted: Sources of market research were the use of FPDS to find previous contracts of the same requirement and with this same proposed vendor, as well as reviewing the proposals submitted in the VA contract writing system eCMS. Also used was personal knowledge of the market by the Contracting Officer

Representative (COR) to assist with detereming the proposed contractor is the only one that is physically located close to the medical facility.

10. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any

Barriers to Competition before Making subsequent acquisitions for the supplies or services required: No actions will likely be explored as this is a specific requirement for the repair and service of highly technical and important medical devices requiring quick turn around and no other contractors are able to meet this requirement.
