About this file

This is a Sole Source Justification and Approval (J&A) document for a Department of Veterans Affairs acquisition.

The VA's Program Contracting Activity Central (PCAC) is awarding a firm-fixed-price purchase order to The Severson Group LLC (Service-Disabled Veteran-Owned Small Business, UEI: L568Q8BV2N23) for adaptive sports instruction and support services for the 2026 National Veterans Summer Sports Clinic (NVSSC) in Orlando, Florida, scheduled for May 2-11, 2026, with veteran events May 5-9, 2026. The estimated contract value is $438,364.59 for the base period plus two option periods. Base period pricing is $143,244.21 (comprising adaptive fitness instruction $7,099; design and printing $24,330; storage containers moving $24,534; storage facility $24,496.32; yoga and meditation $10,000; ropes course instruction $30,580; and management fee $22,204.89). Option periods 1 and 2 are each valued at $146,109.10, reflecting a 2% annual price increase. The contractor must provide qualified instructors for adaptive fitness, yoga, meditation, and ropes course instruction; design and printing services; storage container logistics; equipment maintenance; and compliance with all federal, state, and local safety regulations.

The sole source award is authorized under 41 U.S.C. § 3304(a)(5), 38 U.S.C. § 8127, and VA Acquisition Regulation 819.7008, which permit non-competitive procedures for certified Service-Disabled Veteran-Owned Small Businesses without requiring a determination that only one firm can meet requirements. Market research identified 345 eligible SDVOSBs, with five responses received to the Notice of Intent to Sole Source; all were deemed incapable of meeting the complex integrated requirements for adaptive sports programming, logistics, equipment management, and immediate mobilization. The Severson Group was selected based on demonstrated past performance on the 2023, 2024, and 2025 NVSSC contracts and proven capability to deliver comprehensive adaptive sports services. The contracting officer certified pricing as fair and reasonable based on historical pricing data and an informal quote dated February 13, 2026. Approvals were signed March 24, 2026 by the Contracting Officer and Supervisory Contract Specialist.

1. Contracting Activity:

Department of Veterans Affairs, Program Contracting Activity Central (PCAC) for the National Veterans Summer Sports Clinic (NVSSC) Program.

2237/PURCHASE REQUEST (PR): 675-26-2-8840-0014

2. Nature and/or Description of the Action Being Processed:

This is an individual Justification and Approval (J&A) as required by RFO 6.104 for approval of a single source justification in accordance with Revolutionary FAR Overhaul (RFO) 12.102 restricting competition and RFO 6.103-5.

The National Veterans Summer Sports Clinic (NVSSC) is a yearly event hosted by the Department of Veterans Affairs to provide “a rehabilitative and educational hands-on sporting event for military veterans from across the country who have a range of disabilities including amputations, Post Traumatic Stress Disorder (PTSD), Traumatic Brain Injury (TBI), poly trauma, visual impairments, multiple sclerosis, and spinal cord injuries. Adaptive sports and rehabilitation instruction are the essential services for this event.

Adaptive sports include sailing, surfing, adaptive fitness, kayaking, cycling, yoga, and meditation.”

Founded in 2008, the week-long clinic hosts about 150 veterans from across the country with the fundamental purpose of providing early intervention for those battling back from injury. Rehabilitation events specifically designed for Veterans with disabilities allow eligible participants to gain motivation, improve their independence, achieve a healthier lifestyle, and enjoy a higher quality of life.

Participating in activities that are exciting and fun reinforces to participants that they can successfully adapt to their new lives after an injury, discover new interests and continue to participate in many activities they enjoyed in the past once they return home.”

38 U.S.C. 322(b) Office of National Veterans Sports Programs and Special Events establishes the National Veterans Sports Program and Special Events. The National Veterans Summer Sports Clinic (NVSSC) Program Office coordinates all national veterans’ sports and special events for the VA. In 2025 the NVSSC team made up of VA staff concluded the resources are in place, such as sufficient venues, transportation, and community support to execute the program effectively by the Orlando VA Healthcare System to host the 2026 NVSSC. On September 5, 2023, VHA Rehabilitation and Prosthetic Services received approval from Steven Lieberman, MD, Acting Undersecretary for Health to pilot the 2026 NVSSC to be held in Orlando, Florida.

The 2026 NVSSC hosted by the Orlando VA Healthcare System (VISN 8) will be held in Orlando, FL May 2, 2026 through May 11, 2026. The veteran events will be held from May 5, 2026 through May 9, 2026. 4. Statutory Authority Permitting Other than Full and Open Competition:

( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per RFO 6.103-1;

( ) (2) Unusual and Compelling Urgency per RFO 6.103-2;

( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per RFO 6.103-3;

( ) (4) International Agreement per RFO 6.103-4;

(X) (5) Authorized or Required by Statute RFO 6.103-5;

( ) (6) National Security per RFO 6.103-6;

( ) (7) Public Interest per RFO 6.103-7.

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the

Use of the Authority Cited Above (applicability of authority):

41 U.S. Code (USC) § 3304(a)(5), 38 USC § 8127, and VA Acquisition Regulation (VAAR) 819.7008 provides the express authority to use other than competitive procedures for sole source awards to verified service-disabled veteran-owned small businesses (SDVOSBs). COs may use the non-competitive (sole source) procedures authorized by VAAR 819.7008 for actions not to exceed $5,000,000. Full and open competition need not be provided for when awarding a sole source contract to an SBA certified SDVOSB in accordance with VAAR 819.7008, as authorized. Further, a determination that only one SDVOSB can meet the requirement is not required.

Effective Date: 12/30/2025 Page 4 of 8

In accordance with VAAR 819.7008, and as defined in 38 U.S.C. § 8127, the VA has the statutory authority to award sole source to an SBA certified SDVOSB using procedures other than competitive procedures given the following:

38 U.S.C § 8127(c) implemented through VAAR 819.7008(a) states, in part, “…a contracting officer at the Department may award a contract to a small business concern owned and controlled by Veterans using procedures other than competitive procedures if –

1) The anticipated award price of the contract (including options) will not exceed $5 million;

2) The requirement is synopsized and the required justification pursuant to FAR 6.302-5(c)(2)(ii) is posted in accordance with FAR part 5;

3) The SDVOSB has been determined to be a responsible contractor with respect to performance; and

4) In the estimation of the contracting officer contract award can be made at a fair and reasonable price that offers best value to the Government.

The implementing regulations at VAAR 819.7008 (b) & (c) state in part:

b) “The Contracting Officer’s determination whether to make a sole source award is a business decision wholly within the discretion of the contracting officer…”

c) “A determination that only one SDVOSB can meet the requirement is not required…”

As stated above, the determination whether to make award to an SDVOSB on a competitive basis, rather than on a sole source basis, where the same objective (i.e., award to an SDVOSB) will be met is a business decision wholly within the discretion of the Contracting Officer and a determination that only one SDVOSB can meet the requirement is not required as decided in the Government Accountability Office (GAO) Protest B-419691, dated June 24, 2021.

“Here, the VA awarded the short-term, sole-source contracts to RAS pursuant to the agency’s authority under the Veterans Benefits Act. As emphasized above, the VA is required to set aside certain procurements “[e]xcept as provided . . . in subsections (b) and (c) . . . .” 38 U.S.C. § 8127(d).

Subsections (b) and (c) of the statute set forth the VA’s authority under the Veterans First Contracting Program to award sole-source contracts to SDVOSBs. See 38 U.S.C. §§ 8127(b) and (c).

Because the VA complied with the requirements of the statute and section 819.7007(a) of the VAAR, we find unobjectionable the VA’s action in awarding the sole-source contracts to RAS--an eligible SDVOSB firm. Accordingly, the protester’s assertion that the VA should have competed the procurements is without merit, because the requirement to set aside certain procurements only applies when the VA does not use its sole-source authority--as it did here--under the Veterans First Contracting Program. Crosstown Courier Serv., Inc., supra at 3-4.”

The Severson Group’s past performance indicates they are technically qualified and have previously provided the same services for the 2023, 2024, and 2025 NVSSC events. Past performance indicates The Severson Group has the adequate resources to fulfill the Government’s needs and possesses the technical knowledge and expertise necessary to provide the required services.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

Market research was conducted to determine whether there were any other SDVOSB or VOSB concerns potentially capable of providing the required services as described in the PWS (see section 8 below for details). Five (5) responses were received in response to our Notice of Intent to Sole Source. These responses were reviewed by the program office and determined not capable of meeting our requirements.

As stated in section 5 above and in accordance with VAAR 819.7008(b) and (c), the determination to make a sole source award to an SBA-certified SDVOSB is a business decision wholly within the discretion of the Contracting Officer and a determination that only one SDVOSB can meet the requirements is not required.

7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable:

The Program has developed an Independent Government Cost Estimate (IGCE) for this requirement. It is based on an informal quote provided to the program office on February 13, 2026 and historical pricing for the 2023, 2024, and 2025 NVSSC. The option period pricing (for the 2027 and 2028 NVSSC) is based on a 2% price increase per line item per option. The Contracting Officer received a copy of the two previous orders for the same services: 2023 NVSSC and the 2024 NVSSC (with an option 2025 NVSSC) which will be used to determine the pricing fair and reasonable prior to award.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:

Market Research Techniques

A Notice of Intent to Sole Source 36C77626Q0117 was posted to Contract Opportunities via sam.gov on February 25, 2026. Any responsible source who believed was capable of meeting the requirement was requested to submit a capability statement, proposal, or quotation, which may be considered by the agency, only if received by the closing date and time of the notice.

In accordance with VA Acquisition Regulation (VAAR) 810.001-70, a search was conducted in the SBA Small Business Search at https://veterans.certify.sba.gov/ for SDVOSBs with the applicable NAICS code of 611620. A total of 345 SDVOSB concerns were found. On February 25, 2026, after posting of the Notice of Intent to Sole Source, an email was sent to all 345 SDVOSB concerns with NAICS code 611620 including the link to the posting and requesting responses no later than March 4, 2026 at 10:00 AM (Eastern).

A total of five (5) responses were received. Below is a list of the vendors who responded to the notice.

The RFI responses were sent to the program office for review on March 17, 2024 and the following is the results of the program’s review of the responses:

• FLY Skates and LTSi do not reference or include the moving and coordination of storage containers or equipment include a storage container facility or the handling of equipment.

• Technology Science Corp, Soza Wellness, and ALT3R EGO Fitness respondees did not provide specific details or plans on how the coordination of services will occur; did not explicitly cover the logistics plan or timeline of moving storage containers to Orlando or did not clearly specify a local storage presence in Orlando; they did not provide a clear strategy for moving and managing storage containers including handling equipment; did not include detailed plans for how they will coordinate to ensure all program activities are aligned with the VA expectations and schedules;

and responses did not explicitly state their compliance with federal, state and local safety requirements to ensure they can adhere to legally mandated standards.

• Additionally, Technology Science Corp does have NAICS 611620 identified in their SBA Small

Business certification; however, their primary markets are program management, communications, enterprise/network security and operations, cybersecurity, and data center operations [NAICS Series 541].

Market Research Sources. In accordance with FAR Part 10 and VAAR Part 810, market research has been conducted for this acquisition. The following additional collaborative techniques were used:

Program Sources: The program conducted initial market research in late 2025 and early 2026 by reviewing the SDVOSB and VOSB concerns registered in SBA’s Small Business Search as well as SAM registrations under NAICS 611620. The program also reviewed prior VA adaptive sports program vendors, conducted internet research for vendors specializing in adaptive sports programming, and consulted with program support subject matter experts.

The findings determined that, while there are multiple SDVOSB and VOSB vendors who can offer general fitness instruction and recreation services, these vendors cannot also offer integrative adaptive sports programming, certified adaptive instructors, logistics and participant coordination and support, experience working with veterans and VA programs, and the capability of mobilizing within a short timeframe. The vendors identified offered only single-discipline instruction, lacked adaptive certification or experience, cannot provide full logistical and operational support, and require extended planning timeframes.

After this review, the program determined only THE SEVERSON GROUP LLC is capable of meeting the complex needs to support our veteran attendees to carry out the NVSSC adaptive sports clinic. THE SEVERSON GROUP has demonstrated, through past performance, their experience providing adaptive fitness and wellness instruction, they have proven experience delivering adaptive sports programs, the https://www.acquisition.gov/far/part-10 https://www.va.gov/oal/library/vaar/vaar810.asp

Effective Date: 12/30/2025 Page 7 of 8 ability to begin performance immediately, experience coordinating multi-activity adaptive programs, the ability to provide all storage and logistical support for adaptive equipment, and the capability to provide qualified instructors and program support personnel. Finally, the vendor’s integrated service model reduces program risk and ensures a smooth continuity of services.

Contracting Sources: In addition to the Notice of Intent to Sole Source posted to Contract Opportunities, the CO reached out to the COs for the last two (2) contracts/orders to request a copy of the contract/order and the market research report.

Ms. Diana McInnis provided a copy of the market research report for the 2024 NVSSC order [Ref: contract 36C26224C0285]. Contracting conducted market research by searching VetCert for NAICS 611620, performing a review of previous awards on FPDS under NAICS 611620, and used the specialized knowledge from the NVSSC program office to determine THE SEVERSON GROUP LLC is the only source capable of providing the required services at a fair and reasonable price.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

After market research was conducted by the previous contracting activity in April 2023, a sole source purchase order (36C26223P1019) was awarded to THE SEVERSON GROUP LLC (an SDVOSB) for the 2023 NVSSC adaptive supports services. Market research was again conducted in 2024 and determined THE SEVERSON GROUP LLC was the only responsible vendor capable of providing the required services. A stand-alone contract (36C26224C0285) was awarded to THE SEVERSON GROUP LLC (an SDVOSB) for the 2024 NVSSC with one option period (for the 2025 NVSSC).
