Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID:__

1. Contracting Activity: Department of Veterans Affairs, VISN 09, 596 LEX-VAMC Medical

Center Office of the Director/Engineering Service is requesting services with (OMB) vendor for the purpose of participation in this procurement through obligated funding document

2. Brief Description of Services required and the intended use/Estimated Amount:

The Lexington VAMC at the Troy Bowling Campus has a highly complex electrical 480-volt RL-2000 draw-out circuit breaker that controls the hospitals backup electrical power on all floors including critical areas to include the emergency department at the facility. Currently, this machine is not closing electronically with the Close/Trip switch which could potentially be a safety hazard.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

The highly complex nature of this device mandates performance qualifications be meet by the Original Equipment Manufacturer (OEM) specified parameters in order to meet the technical industry UL (Underwriter Laboratories) Standards and the NFPA 99 Health Care Facilities Code. While detailed product comparisons can be made by examining each manufacturer’s data sheets often that examination is inconclusive and may lead to misapplication of the device or rejection of UL Listing for the entire end-product upon submission to UL.

UL service standards require that materials and design used in manufacture remains consistent with the original Recognized device ensuring they meet the parameters of the Listed end product’s specification.

Ability to meet National Fire Protection Association (NFPA) 99 Health Care Facilities Code which establishes criteria for levels of healthcare services or systems based on risk to the patients, staff, or visitors in health care facilities to minimize the hazards of fire, explosion, and electricity.

An Intent to Sole Source Notice was issued on Beta Sam from November 18, 2022 to November 23, 2022, with no additional sources identified. The VA Rule of Two cannot be met for this requirement.

is the first to receive UL listing for a low-voltage solid-state circuit breaker and can meet exact manuforer’s specification. This requirement will be a sole source purchase order awarded to large business, , LLC, IAW FAR 13.106-1(b)-Soliciting from a single source.

4. Description of market research conducted and results or statement why it was not conducted:

VIP: utilizing search parameters, NAICS code 238210, Key Word circuit breaker, no restrictions identified (23)SDVOSB and (5)VOSB with restriction to Kentucky applied due to the urgent safety need of requirement, which returned no results were returned.

Small Business Dynamic (SBA): utilizing search parameters, NAICS code 238210 and key word circuit breaker originally returned 91 small business results. However, for purposes of narrowing search parameters when restriction to Kentucky was applied no results were returned.

General Services Admission (GSA) Advantage: utilizing search parameters, NAICS code 238210 and key word circuit breaker that returned no results.

Federal Procurement Data System-Next Generation (FPDS-NG): utilizing search parameters, NAICS code 238210, PSC code J059 and key words circuit breaker repair returned (10) results from 2005 to 2021 timeframe. Only (1) SDVOSB was identified within the last year, however due to the urgent need does not meet the geographical Kentucky location.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106- 1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
