VHAPM Part 813.106 Page 1 of 1 Original Date: 08/30/17 Revision 02 Eff Date: 03/31/2020
DEPARTMENT OF VETERANS AFFAIRS
Justification for Single Source Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID:
1. Contracting Activity: Department of Veterans Affairs, VISN 12, Great Lakes Acquisition Center located at 115 South 84th Street, Suite 101, Milwaukee Wisconsin 53214. This acquisition is for the Repair Parking Lot B Construction project on behalf of the Oscar G Johnson VA Medical Center, 325 East H Street, Iron Mountain, MI 49801, Purchase Request 585-20-3-6021-0627.
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:
Oscar G. Johnson VAMC, Iron Mountain, Michigan, requires repair of the existing hospital parking lot, section B, and the surrounding gutters, curbs, walkways, etc. The Government estimate for the project is $102,673.23. The contract will be a firm-fixed price construction to complete the work as outlined in the project SOW in 45 days from NTP.
The Government proposes to establish a contract with MBM Construction; Duns# 077481208, CVE- VIP verified, Service Disabled Veteran Owned Small Business (SDVOSB) general construction contractor as a sole-source procurement under the Statutory Authority granted to VA in 38 U.S.C. 8127 (Public Law 109-461 or the Veterans Benefits, Health Care and Information Technology Act of 2006).
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: Statutory authority is prescribed under 38 U.S.C 8127, & 41 U.S.C. 3304(a)(5). Governing regulations are FAR 6.302-5 & VAAR 819.7007 (per Class Deviation 07/25/2016).
4. Description of market research conducted and results or statement why it was not conducted:
Market Research was performed to verify contractor is a CVE-Certified SDVOSB Contractor. MBM construction is mobilized on site and had recently performed similar work on the staff parking lot and MRI pad at the Oscar G Johnson VA Medical Center. MBM Construction is the most qualified contractor to perform the work, and is in the best interest of the Government to sole source this requirement to MBM Construction Company.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b(1)(i).
I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief. Contractor’s itemized cost proposal will be evaluated and compared to the IGE to ensure fair and reasonable price.
