About this file

This document is a Single Source Justification for a Simplified Acquisition Procedure (SAP) from the Department of Veterans Affairs, VISN 22 Greater Los Angeles Healthcare System Police Service. The procurement is for advanced subject control training for VA Police Officers from Effective Fitness Combatives, LLC, valued at $62,865.00. The training focuses on control techniques, reducing liability, and minimizing potential injuries or excessive force events, with the vendor selected based on their specialized expertise and proven track record within VA law enforcement.

The justification highlights an urgent need for training, citing a 2000% increase in disorderly conduct events over the past 36 months. Market research identified 3 Service-Disabled Veteran-Owned Small Businesses (SDVOSB) and 12 Small Businesses in the NAICS Code 611699 category, but the vendor was recommended as a sole source under FAR 13-106-1(b)(1) due to their established performance. The document references several legal case laws supporting the training's importance and was digitally signed by the Contracting Officer, David Odne, with an effective date of 11/15/2024.

1. Contracting Activity:

Department of Veterans Affairs, VISN 22 Greater Los Angeles Heathcare System Police Service 2237: 691-26-3-4098-0036

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The proposed contract is for advanced subject control training for VA Police Officers at GLAHCS. This training focuses on control and effectiveness, reducing liability, and minimizing the possibility of avoidable injuries or excessive force events. The courses include various techniques and principles designed to enhance officers' ability to manage physical altercations effectively. The total estimated amount for these services is $62,865.00

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The vendor, Effective Fitness Combatives, LLC possesses unique characteristics that make them the only suitable source for this training. They have specialized expertise in teaching control and effectiveness during physical altercations, which is crucial for reducing liability and preventing avoidable injuries or excessive force events. Their high reputation within the law enforcement community, particularly among VA law enforcement, further supports their unique suitability. Time restraints do not allow for a full evaluation of other vendors.

Additionally, the vendor has established and proven adherence to ethical and discipline-focused requirements that align perfectly with VA standards and policies. Given their proven track record and positive feedback from VA police who have attended their courses, this vendor provides the highest quality training available, tailored specifically for VA law enforcement needs.

4. Description of market research conducted and results or statement why it was not conducted:

Extensive market research was not conducted due to the urgency of enhancing training and the rapidly evolving environment at GLAHCS, which has seen a 2000% increase in disorderly conduct events over the last 36 months. Based on knowledge of the vendor's reputation and excellence in training results to include direct feedback of VA officers who have attended open enrollment classes within the last 6 months, there was a clear necessity to engage a proven provider who can meet VA Police’s specific requirements immediately. The vendor's existing high reputation within the law enforcement community, particularly when considered in the space of the VA’s unique law enforcement mission, supports their unique suitability and ability to deliver the required training without delay. A second market research was conducted by Contract Specialist and found that DSBS database with NAICS Code 611699, found 3 potential SDVOSB’s and 12 Small Business. However, after further Statement of Work discussions with end user and Branch Chief/Contracting Officer it https://www.acquisition.gov/?q=/browse/far/13

Revision: 01 Effective Date: 11/15/2024 Page 2 of 2 Acquisition ID#: 36C262-26-AP-2243 was recommended that we had sufficient justification to recommend this requirement as a sole source IAW: FAR 13-106-1(b(1). This vendor's established performance, particularly within VA law enforcement, justifies this decision. Training is essential due to current concerns, immediate needs, and the requirements highlighted in relevant case law such as City of Canton v. Harris (1989), Popow

v. City of Margate (1979), Zuchel v. City and County of Denver (1993), Spell v. McDaniel (1987), and Walker v. City of New York (1987)

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
