VHAPM Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under the SAT

VHAPM Part 813.106 Page 1 of 1 Original Date: 08/30/17 Revision 02 Eff Date: 03/31/2020

DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1

For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C258-21-AP-1356, Emergency 6th Avenue Main Gate Replacement

(SAVAHCS).

1. Contracting Activity: Department of Veterans Affairs, NCO 22-Gilbert, Southern Arizona VA

Health Care System (SAVAHCS), 3601 S. 6th Avenue, Tucson Arizona. PR: 678-21-3-616-0900

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

Emergency replacement of SAVAHCS 6th Avenue main gate damaged by an off-campus driver.

Includes materials and labor to design, fabricate, and replace. Amount quoted is $25,320.00.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: SAVAHCS is on the National Register of Historical Places.

Because of this designation, the gates must be replicated using the original design. According to

Yasdany Morales, the project POC, Premier Metals, Inc. has provided all metal fabrication requirements at SAVAHCS (over 600 transactions in IFCAP since 2012), and are uniquely qualified in the design and fabrication methods used on campus in the past, ensuring the facility’s character maintained well into the future. In addition, IAW VHA Procurement Manual (Revision 11), Part

806.3, paragraph 3.1.1., the use of Unusual and Compelling urgency was authorized by NCO-22’s

Director of Contracting, Sabrina J. Smith (See attached email) that limits or precludes full and open competition.

4. Description of market research conducted and results or statement why it was not conducted:

Not conducted IAW FAR 6.302-2(a)(2), Unusual and Compelling Urgency. When the agency’s need for the supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals full and open competition need not be provided for.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.

All, please consider the following for an emergency:

In accordance with the VHA Procurement Manual (Revision 11), Part 806.3, paragraph 3.1.1., your authorization to move forward with this emergency procurement based on an Unusual and Compelling Urgency justification is required. Please respond positively or negatively your approval to proceed with the EMERGENCY procurement for Unusual and Compelling Urgency reasons.

The request for a repair of the west main gate entry located on 6th Ave for entry into the SAVAHCS campus. The gate is a main entry point for employees Monday Friday, 0630 1830, closed at night and weekends, that was damaged by a an off-campus driver during closed hours. The need to repair this as an emergency is needed due to the extra security that is required to support the entry point and the possibility of having to expand the current security contract to cover an additional entry point. The selected contractor has done work previously at the facility and is familiar with the process and procedures to work at a federal facility. The manufacturing of the gate will require 30 day lead time so it is imperative to move forward with this requirement as soon as possible to minimize the security of the facility. The requirement will be assigned to Mike Williams which will include the posting of the sole source to RPOW JOFOC tracker, any questions let me know, thanks.

Pending your approval of the emergency request, a purchase order using simplified Acquisition Procedures will be contemplated in the estimated amount of $25,000.00, no OT will be needed for the requirement.
