About this file

This is a Sole Source Justification for a Federal Supply Schedule (FSS) order under the General Services Administration Multiple-Award Schedule Program.

The Department of Veterans Affairs, Network Contracting Office 08 (Tampa, FL) is issuing an emergency order against FSS Contract Number 36F79719D0024 to Abbott Laboratories, Inc. (Abbott Park, IL) for Clinical Chemistry and Immunochemistry cost-per-reportable-result (CPRR) services with clinical laboratory automation, instrumentation, and software. The requirement supports four Tampa VA Healthcare Network locations: James A. Haley Veterans Hospital, New Port Richey VA Outpatient Clinic, Lakeland Community-Based Outpatient Clinic, and Temple Terrace VA Clinic and Mental Health Facility. The Period of Performance is April 1, 2026 through March 31, 2027. The CPRR pricing model includes all support, equipment, reagents, controls, calibrators, consumables, solutions, probes, reaction vessels, sample cups, and shipping charges necessary for instrument operation and test results.

The sole source justification is based on an urgent and compelling need, citing the departure of the assigned Contracting Officer and insufficient time to execute a longer-term solution. The justification emphasizes that the chemistry-immunology laboratory section performs approximately 70 percent of all testing across these four sites, and failure to maintain continuity would result in systemic breakdown in patient testing and potential patient harm. Market research indicated no known Service-Disabled Veteran-Owned Small Businesses (SDVOSB) or Veteran-Owned Small Businesses (VOSB) capable of supporting the requirement in the applicable Federal Supply Codes (605-6A and 605-1A). The justification includes approvals from the Contracting Officer, supervisory level management, and VHA RPO HCA for orders exceeding $900,000.

• Lakeland Community-Based Outpatient Clinic (LCBOC), 2080 Meadowland Park Blvd, Lakeland, FL 33803

• Temple Terrace VA Clinic and Mental Health Facility (TTMHF), 8451 Temple Terrace Highway Tampa, FL 33637

Period of Performance (POP): 04/01/2026 – 03/31/2027

The COST PER REPORTABLE RESULT (CPRR) includes: all support, equipment, reagents, controls, calibrators, consumables, precipitant reagents, solutions, wash buffer, wash zone probe, cleaning solutions, trigger solutions, probes, septums, reaction vessels, sample cups, replacement caps and includes shipping charges for such items necessary for instrument operation to obtaining a test result.

4. Identify the Authority and Supporting Rationale (see below and if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

GSAM/R 538.7104-3(b)(1)(i): An urgent and compelling need exists and following the ordering procedures would result in unacceptable delays: The Contracting Officer assigned to this requirement left the organization and subsequently there was not enough time to execute a longer-term solution. This created an emergency need for immediate support to this requirement. This has an immediate and significant impact on operations and presents unacceptable risk across four affected locations: James A. Haley Veterans Hospital (JAHVH), New Port Richey VA Outpatient Clinic (NPROPC), Lakeland Community-Based Outpatient Clinic (LCBOC), and the Temple Terrace VA Clinic and Mental Health Facility percent of all testing for these sites. Failure to proceed with the current vendor and the currently installed instrumentation would result in a systemic breakdown in patient testing and clinical service continuity, creating conditions that could lead to patient harm or death.

Continuity of testing and clinical services is therefore mandatory for the VA to fulfill its mission. This constitutes a life, health, and safety risk that is paramount to maintaining uninterrupted operations.

GSAM/R 538.7104-3(b)(1)(ii): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized;

GSAM/R 538.7104-3(b)(1)(iii): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under sole source or limited source procedures.

Procedures

GSAM/R 538.7104-3(b)(1)(iv): It is necessary to place the order with a particular FSS contractor to satisfy a minimum guarantee established in the FSS BPA; or

GSAM/R 538.7104-3(b)(1)(v): A law expressly authorizes or requires that the purchase be made from a specified source.

GSAM/R 538.7104-4: Items peculiar to one manufacturer:

5. Describe Why You Believe the Order Represents the Best Value consistent with GSAM/R 538.7102-2(4) to aid the contracting officer in making this best value determination: This action represents the best value to the Government as it accomplishes acquisition strategy and conduct a robust competition. Next, it accounts for the reasonable and necessary timeframe for deployment, integration, and validation of any new systems.

Finally, it ensures the VA’s mission to support and care for our Veterans remains uninterrupted; any lapse in meeting these testing requirements would result in a failure of systems and operations essential to the delivery of healthcare, which is wholly unacceptable.

GSA schedules have already been determined fair and reasonable.

6. Describe the Market Research Conducted among schedule holders and the results or a statement of the reason market research was not conducted. Market research has indicated there are currently no known SDVOSB(s) or VOSB(s) capable of supporting this requirement as evidenced from data referenced in the SBA’s Dynamic Small Business Search. In addition, the VA has determined schedule 65 and 66 FSC contracts are mandatory for use as strategic sourcing. There were no SDVOSB or VOSBs in FSC 66 III categories for Clinical Immunochemistry Analyzers or Clinical Chemistry Analyzers (605-6A and 605-1A respectively).

7. Any Other Facts Supporting the Justification: This action is an emergency to support critical laboratory operations while the Government pursues the acquisition efforts necessary to provide a more appropriate solution.

8. A Statement of the Actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made: The period of performance for this action provides the minimum duration needed to conduct follow an appropriate acquisition strategy which must include consideration of the estimated after award needed to install, test, and certify any new equipment for operational use. These steps directly address and mitigate the barriers that previously limited competition by ensuring vendors will have adequate time for proposal development, contract award, system deployment, and operational validation. The Government intends to maximize competition through the appropriate acquisition methodology. This current action therefore establishes the minimum timeframe necessary to remove those barriers and support those objectives.
