DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1

For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C256-21-AP-3192

1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office 16 (NCO-16), in support of VISN

16, Alexandria VA Medical Center, Engineering Department, 2495 Shreveport Hwy 71 North, Pineville, LA 71306.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The specific items being requested are the following: Kawasaki Mule 4010 Trans 4 x 4 Utility Vehicles. The total estimated cost of this acquisition is approximately $89,103.00.

3. Statutory Authority: FAR 6.302-1 (Only one source and no other supplies will satisfy agency requirements) applies to this acquisition because brand name items are being procured (which in turn does not allow for full and open competition as stated in this part). In accordance with FAR 6.302-1(c)ii(c) and FAR 5.102(a)(6) this justification will be provided to all interested parties if/when a solicitation is executed for this acquisition.

4. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: For this specific procurement, brand name items are required because the Kawasaki Mule 4010 Trans 4 x 4 Utility Vehicles meet the facility’s unique technical and functional requirements which includes ensuring compatibility, consistency, uniformity, reliability, functionality, and familiarity with the existing vehicle fleet. This includes but is not limited to training, ease of use, spare parts, warranties, and other existing agreements for repair & service. The facility’s current vehicle fleet already consists of Kawasaki Mule 4010 Trans 4 x 4 Utility Vehicles that are currently in use. This procurement is for the purchase of replacement Kawasaki Mule 4010 Trans 4 x 4 Utility Vehicles to replace older Kawasaki Mule 4010 Trans 4 x 4 Utility Vehicles that have reached/exceeded their lifespan for use. The vehicles being replaced are Beyond Economic Repair (BER). The purchase of these vehicles is needed to ensure that the Engineering vehicle fleet operates at its expected capacity to continually meet facility needs. Or equal, or equivalent, alternate, and/or substitute offerings will not meet the government requirements (and these non-brand name offerings cannot be modified or altered to meet government requirements).

5. Description of market research conducted and results or statement why it was not conducted: Market research was conducted for this procurement and it was found that competitive acquisition procedures can be utilized. These specific brand name items are available on GSA contract/schedule from multiple non-veteran, small businesses and can also be provided from Service-Disabled Veteran Owned Small Businesses (SDVOSB’s) (and Veteran Owned Small Businesses (VOSB’s)) on the open market. IAW applicable regulation, policy, and guidance an appropriate set aside (through the appropriate acquisition channels) will be utilized when this requirement is solicited.

6. Contracting Officer's Certification: This purchase meets the requirements of FAR13.106-1(b) to include price fair and reasonableness as stipulated in FAR 13.106-3. I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
