4. Statutory Authority Permitting Restricted Competition:

FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

(X) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements

( ) Unusual and Compelling Urgency ( ) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert

Services ( ) International Agreement ( ) Authorized or Required by Statute ( ) National Security ( ) Public Interest

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

The Progressive Plus ICU bed is essential for improving patient outcomes as it includes unique advanced features (e.g., microclimate management, percussion and vibration therapy, and Intellidrive mobility) that are highly specialized and necessary for the East Orange VA Medical Center's patient care needs. These capabilities are crucial for preventing pressure injuries, promoting respiratory health, and ensuring unique design and functionality directly align with the VA’s mission to provide the highest standard of care to its veterans. No other product has been identified that meets the required specifications at this level of quality and performance.

The Progressa Plus ICU bed system is designed to address the unique challenges faced by medical professionals working in hospital ICU settings.

Protects patients from injuries: Progressa Plus beds have advanced surfaces that manage heat, moisture, pressure, shear and friction, which help prevent hospital-acquired pressure injuries. These beds also make it easier to position patients by helping to prevent sliding and allows clinicians to turn patients with the press of a button.

In-bed pulmonary therapies: Progressa Plus beds allow clinicians to delivery pulmonary therapies like chest physiotherapy and continuous lateral rotation with the press of a button while the patient is still in bed. Clinicians can delivery these therapies without the need for additional devices or help from other clinicians.

Acquisition ID#:

Patient mobility: Progressa Plus beds helps patients safely stand with the one button FullChair position. These beds also support an early mobility protocol that provides a framework for assessments and interventions aimed at promoting safe and effective mobilization throughout all the phases of a patient’s care.

The East Orange VAMC already uses Progressa ICU beds and is looking to expand their fleet.

Completing their fleet with the same make and model bed will allow medical staff to effortlessly continue operations without having to be trained on how to use a new bed system. In addition, the Progressa Plus beds are compatible with the Hill-Rom nurse call system used at the facility.

Accordingly, the Progressa Plus ICU bed manufactured by Hill-Rom is the only bed capable of meeting the Government’s needs described in Section III above without the Veterans Health Administration experiencing substantial duplication of cost that could not be expected to be recovered through full and open competition.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

As stated in Section VIII below, the ICU Nurse Manager at the East Orange VAMC contacted representatives from several ICU bed manufacturers and determined that only the Hill-Rom Progressa Plus beds from Hill-Rom offered the features and capabilities that met the needs of the Nursing department.

Hill-Rom is the original equipment manufacturer (OEM) and they have two Service-Disabled Veteran Owned Small Businesses (SDVOSB) that are authorized to distribute these beds. A combined synopsis/solicitation will be posted to sam.gov.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:

A solicitation will be posted to sam.gov and it’s expected that quotes will be received from Hill- Rom’s two authorized distributors so price reasonableness will be based on competitive quotes IAW FAR 13.106-3(a)(1). Quotes received will be evaluated by the requiring activity to confirm technical acceptability. Certified cost or pricing data will not be required and is not applicable to this acquisition.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons

Market Research Was Not Conducted:

Market research was conducted in January - May of 2025.

During initial market research efforts, the ICU Nurse Manager at East Orange VAMC contacted representatives from the below companies to obtain information on their product offerings. It was determined that the Progressa Plus ICU bed system from Hill-Rom offered the features and capabilities that met the needs of the Nursing department.

1) Stryker Medical - Lou Eliades at Lou.Eliades@stryker.com

2) Baxter International (Parent company of Hill-Rom) - Linda Curto at Linda.Curto@baxter.com

3) Arjo Inc. - Jarret Gonzalez at Jarret.Gonzalez@arjo.com

A search of VetCert using NAICS 339113 identified 933 SD/VOSB vendors. A search of SBA using NAICS 339113, and keyword “bed” identified 1 relevant VOSB and 11 relevant SDVOSBs. A search of SBA using keyword “progressa” returned 0 results.

A search of FPDS using keyword “progressa” returned 160 contract actions awarded by the VA, with 133 of those being awarded to Hill-Rom, Inc.

A search of the VA National Acquisition Center and GSA Advantage websites revealed that the Progressa Plus ICU bed model is not available on a Federal Supply Schedule or Blanket Purchase Agreement and this was also confirmed by the OEM.

Hill-Rom, Inc. is the original equipment manufacturer of the Progressa Plus ICU Bed and is not a small business. They have confirmed to this office that they have two authorized distributors for this equipment – Geo-Med, LLC and DiSorb Systems, Inc, both are SDVOSB’s.

As described in Section 6 above, market research was conducted in accordance with FAR Part 10. A combined synopsis of the proposed acquisition/solicitation will be posted to sam.gov, advising industry of the pending acquisition and soliciting quotes from interested parties.

The required supplies are manufactured in the United States. Trade Agreements apply; clause 52.225-5 Trade Agreements and provision 52.225-6 Trade Agreements Certificate will be used.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

None.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

None.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to

Competition before Making subsequent acquisitions for the supplies or services required: To overcome barriers to competition in the future for this requirement, the Nursing department would have to replace their entire fleet of Hill-Rom beds and components/accessories. The time and cost needed to replace all equipment, and the downtime associated with training staff on how to use the replacement equipment would not be cost effective. Therefore, no other source can provide the proprietary components required to meet the Government’s needs.

12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
