About this file
This document is a Sole Source Justification under Simplified Procedures for Certain Commercial Items for the Department of Veterans Affairs, VISN 17, Central Texas VA Medical Center. The justification is for a twelve-month firm-fixed-price service contract with four one-month option periods for preventative maintenance of two Illumina NextSeq sequencing instruments: NextSeq 550 (Serial No. NB552004) and NextSeq 550dx (Serial No. NDX550798) located in Research Building 205.
The contract is being awarded directly to Illumina as the sole manufacturer and service provider, with no competitive bidding. Market research was conducted in April 2025, including searches of federal procurement databases, and an intent to sole source was posted on SAM.gov. The justification emphasizes that Illumina is the only source capable of providing maintenance for these specialized sequencing systems, and that alternative providers would result in additional costs for equipment and staff training. The anticipated contract value will be evaluated for fair and reasonable pricing through comparison with current market prices and previous purchases.

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): This is limited source justification in support of FAR 6.302-1Only one responsible source and no other supplies or services will satisfy agency requirements. Illumina is the sole manufacturer and service provider for the Illumina NextSeq 550 and NextSeq 550Dx sequencing instruments. These sequencing systems are highly specialized systems that require regular maintenance to provide accurate results. Illumina is the sole source of the maintenance support for the NextSeq 550 and NextSeq 550Dx sequencing systems. Procuring an alternate brand would also result in duplication of costs to the government in the form of additional equipment, and staff training. The replacement of current government owned equipment is not expected to be recovered through competition.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Market Research was conducted and while other companies provide Illumina NextSeq Service, Illumina NextSeq Service agreement restrict other sources/distributors from providing maintenance services to this product.” An intent to sole source was issued May 7th -12th via SAM.gov , that also yielded one response The vendor stated in their technical capability statement: that they “would incorporate service from Original Equipment Manufacturer and qualified Independent Service Organization Engineers to perform services throughout the contract term”. The contracting team and VA service team reviewed the response and determined that the vendor can only offer the government third-party preventative maintenance. Illumina has not authorized any third party intermediary to provide maintenance for their products. During a phone call with Illumnia (representative) expressed any maintenance should be completed by them and not through a third party entity.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: Price is expected to be fair and reasonable and will be evaluated against prices in the current market for similar items and services, comparison of proposed prices found reasonable on previous purchases, current price catalogs Illumina, Inc. change the public and other Government entities for the same items and services, and comparison to the Independent Government Estimate.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: The Contract Specialist (CS) conducted market research in April 2025, by searching Federal Procurement Data System (FPDS); General Services Administration (GSA e-library), Veteran Small Business Certification (Vet Cert), to determine if there were any vendors capable of providing service for the CTX Illumina NextSeq Service Contract.

The CS also posted a Notice of Intent to sole source which yielded 1 response as outlined in section 6 of this document. It is reasonable to consider that there is no competition for this contract action and thus a direct award should be made to Illumina as they can provide the preventative maintenance as describe in the SOW.

Any additional facts apply.
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed.
