About this file

This document is a justification for a single source award over the micro-purchase threshold but not exceeding $250,000. The Department of Veterans Affairs, VISN 02, VA New Jersey Medical Center requires replacement of the patient positioning laser system used in surgery simulation for veterans. The current system is end of life, end of guaranteed service, and runs on an unsupported operating system. The required replacement is four Valley Lab Generator FT10 units valued at $90,854.94. This generator is the only product that utilizes TissueFect technology which examines device performance 434,000 times per second to effectively and efficiently deliver energy during electrosurgical and advanced bipolar procedures. Market research showed previous purchases were from Valley Lab or its authorized distributor, and Valley Lab is the original equipment manufacturer for this specialized technology.

Brief Description of Supplies/ Services required and the intended use/Estimated Amount: This is a new requirement for the replacement of the patient positioning laser system for use in surgery simulation of veterans. The current system is end of life (EOL), end of guaranteed service, and runs on an unsupported computer operating system (Windows XP) which is being retired due to security vulnerabilities. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: TissueFectTM (Ligature) technology examines device performance 434,000 times per second, monitoring tissue impendence and allowing effective and efficient energy delivery. This technology is only available on ValleyLabTM generators and drives all electrosurgical and advanced bipolar functions.

4. Description of market research conducted and results or statement why it was not conducted:

Searched FPDS of all historical procurements since 2017, which yielded Six (6) purchases five (5) from VHSS and one (1) from Medtronic’s. Search of SBA VetCert database using NAICS code 334510 yielded 309 possible vendors, search of VIP VetBiz database using NAICS code 334510 yielded 180 possible vendors. Searched VA NAC Medsurg database which yield current/valid VA National contract # 36F79721D0175. Further searched GSA Advantage which yielded no results, and GSA eLIBRARY using 36F79721D0175 which yield VHSS as an authorized distributor for Medtronic’s. I placed a call to Medtronic’s (OEM) 1-800-962-9888 requesting a list of authorized distributors and was referred to sales rep. Mark Osterman (314-378-3437 / Mark.A.osterman@medtronic.com) as the POC. I sent the sales rep an email requesting confirmation of authorized Vet Owned distributors.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR 13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
