About this file
This document is a single source justification for awarding a contract to Charter Communications for digital cable TV services at the VA Saint Cloud Health Care System in Minnesota. Charter/Spectrum is the only provider that can supply digital TV programming through an underground cable system, as required to comply with the Minnesota State Historic Preservation Board given the historic designation of the VA campus buildings. Spectrum is the incumbent provider and currently uses underground cable to deliver the digital TV signal. The justification cites the Minnesota State Historic Preservation Office's declination of requests to install satellite dishes on campus buildings. The contracting officer certified the justification as accurate and complete, noting the requirement to determine price reasonableness according to FAR 13.106-3. The related federal contract opportunity notice was for awarding a contract to Charter Communications for cable TV services at the VA Saint Cloud Health Care System.

VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under the SAT
Last Updated: 02/01/22 Page 1 of 1
DEPARTMENT OF VETERANS AFFAIRS
Justification for Single Source Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: 36C263-23-AP-2078
1. Contracting Activity: Department of Veterans Affairs, VISN 23, Saint Cloud Medical Center
2237: 656-23-3-037-0071
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:
Digital Cable TV Services
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: Charter/Spectrum currently provides digital TV signal via underground cable to this station. The St. Cloud VA Campus is officially recognized as a State Historic Site and therefore the MN Historical Society must approve all construction and modifications to the campus buildings. The Minnesota State Historic Preservation Office (MNSHPO) has declined requests to attach satellite dishes to the sides or on the roof of any of the buildings on campus. Charter Communications is the only provider of digital TV programming supplied by underground cable in the St. Cloud Area. Underground cable is the sole vehicle to provide TV signal to VAMC Patients, that allows the medical center to remain in compliance with the State Historical Preservation Board.
4. Description of market research conducted and results or statement why it was not conducted:
Researched for cable TV services in the area and there are only 3. Dish and Direct TV provide services only using an installed dish which is against MNSHPO. Therefore, Charter/Spectrum is the only contractor who can provide underground cable TV services for the St. Cloud VA.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
Note: COs are required to make a determination of price reasonableness IAW FAR 13.106-3. See the S19 Open Market (FAR13) Award Documentation Form with Abstract to document price reasonableness.
