(1) Contracting Activity: Department of Veterans Affairs, Network/Program Contracting Office 04, VISN 04, in support of VISN 4 James E Van Zandt VA Medical System.

(2) Description of Action: This acquisition is conducted under the authority of the Multiple-Award Schedule Program (41 U.S.C. 152(3) and 40 U.S.C. 501). The proposed action will be a Three (3) year Firm Fixed Priced BPA, where the requested supplies will be ordered on an as needed basis. The VISN 4 facilities included in this requirement are Altoona, Butler, Coatesville, Erie, Lebanon, Philadelphia, Pittsburgh, Wilkes-Barre, and Wilmington’s VAMCs.

Order against: FSS Contract Number: V797D-70260

Beckman Coulter, Inc.

250 S. Kraemer Blvd Brea, CA 92821

(3) Description of Supplies or Services:

This request is for the continuation of Urinalysis Chemistry and Microscopic testing with Beckman Coulter Inc for uninterrupted continuity of care for our veterans. The contractor shall provide all equipment, reagents, standards, controls, supplies, consumables, parts, accessories, and any other item required for the proper operation of its contractor-owned Urinalysis Chemistry and Microscopic testing analyzer and the generation of results on a Cost per Test (CPT) basis.

VISN 4 will provide an estimated volume by test as reflected in Attachment A for each individual medical center and outpatient clinic laboratory. Pricing is based in the AVERAGE daily test volume per instrument/analyzer for each facility. The Government estimates the volumes per facility as listed in Attachment A but does not guarantee volumes as listed;

they are estimates only.

The estimated value of the proposed action is $

Period of Performance: Estimated Value:

Year #1 08/01/2022 – 07/31/2023 Year #2 08/01/2023 – 07/31/2024 Year #3 08/01/2024 – 07/31/2025

(4) Identify the Authority and Supporting Rationale (see below and if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

FAR 8.405-6(a)(1)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under sole source or limited source procedures.

VISN 4 previously awarded 36C24420A0011 to Beckman Coulter Inc, competed under solicitation 36C24420Q0153. This acquisition was competed on GSA eBuy. Two offers were received. Beckman Coulter was the only technically acceptable offeror. Their allowable ceiling rates for the two different tests were $1.67 and $3.90. They discounted those prices at $1.30 and $3.60. Additionally, they came in below the IGCE by $145,119.10. Based on competitive pricing, discounts on their approved GSA rates the price they proposed is fair and reasonable.

(5) Describe Why You Believe the Order Represents the Best Value consistent with FAR 8.404(d) to aid the contracting officer in making this best value determination:

The analyzers have been in use for the last 2 years, and the previous 5 years prior. If a new analyzer was brought into the facilities, it would take upwards of six months to calibrate and validate them. Also, we would need to correlate the new method to the old method. We would need to retain our current analyzers to compare the results of the new analyzer with the results of the old analyzer to ensure there is no major discrepancy. All staff would need retrained prior to going live with new analyzers. There is a major shortage in staffing at all facilities, due to COVID and a national shortage of all laboratory staff. With the lack of staff, it would be very time consuming to get all the current staff trained to use a new analyzer and on interpreting results from a different vendor, which would interrupt continuity of care for our veterans.

(6) Describe the Market Research Conducted among schedule holders and the results or a statement of the reason market research was not conducted.

A Source Sought was posted on 7/5/22 - & 7/11/22 at 12 Noon EST on GSA RFQ1568801 & FedBiz Opps 36C24422I0910. Two responses were received. The two vendors responded to the notice were Beckman Coulter and Sysmex America Inc. Beckman also provided proprietary letter for the current equipment being used in the VA only their supplies will work in our current equipment. Three vendors were identified on GSA, VIP search by NAICS code 325413 – Zero Results, FPDS search of 325413 & Urine Testing.

(7) A Statement of the Actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made Beckman Coulter is required for the continuation of our Urinalysis Chemistry and Microscopic testing. We are currently using Beckman Coulter analyzers which are proprietary and can only be supplied and serviced by Beckman Coulter. The Urine Chemistry and Microscopic results are accurate and quickly obtained, which provide the practitioners with important needed information about the veteran’s health to treat any potential ailments and provide uninterrupted care to our Veterans.

I understand that processing of this limited sources justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by FAR Subpart 8.4.
