About this file
This is a Limited Sources Justification document for an urgent procurement of two Steris V-Pro maX 2 Sterilization systems for the Fargo VA Health Care System, citing FAR 8.405-6(a)(1)(A) for urgent and compelling need. The procurement, under Acquisition ID 36C263-25-AP-0870, is being conducted through the Multiple-Award Schedule Program with Steris Corporation under FSS Contract Number V797D-60613.
The justification explains that both of the facility's existing V-Pro Sterilization machines are simultaneously non-operational, creating an emergency need for immediate replacement to maintain essential sterilization services for medical devices. The procurement includes installation and de-installation services, along with trade-in credit for old equipment. Key factors supporting the sole-source justification include compatibility with existing Steris ConnectAssure Technology software already licensed by VA VISN 23, coverage under an existing Steris service contract, and the urgency of maintaining patient care services. The equipment is confirmed to be Buy American Statute compliant, and the VA is requesting a price reduction per FAR 8.405-4. The document was approved by facility leadership and contracting officials in December 2024.

(4) Identify the Authority and Supporting Rationale:
FAR 8.405-6(a)(1)(A): An urgent and compelling need exists and following the ordering procedures would result in unacceptable delays.
This is an emergency order as a result of unusual circumstances. The Fargo VA Medical Center currently owns and uses two V-Pro Sterilization machines. Both of the machines are simultaneously experiencing operating issues and need to be replaced as the Medical Center is unable to use either one.
As stated above, the equipment performs Cleaning, Disinfection, and Sterilization of essential reusable medical devices. This equipment provides effective and efficient sterilization, safeguarding the health and safety of patients. Having the only two machines in non-operable condition leaves the VA in need of immediate replacements. The urgency of the current circumstance does not allow the time needed for normal competitive procedures or the ability to consider a different brand.
Additional information:
This Steris Brand equipment pairs with Steris ConnectAssure Technology data export software, which enable the processor to facilitate data transfer between all devices. Access to the ConnectAssure software and the licensing is purchased by the VA VISN 23. ConnectAssure monitors the SPS equipment, including performance data, alarm logs, cycle data, service parts and maintenance history. ConnectAssure is proprietary to Steris. The system helps to maximize response time and alerts technicians to problems. This results in less down time and helps to keep the department functioning. It would be a significant hardship to the Government if the entire system had to be replaced with another program instead of just replacing the two needed pieces of equipment.
VA VISN 23 already has a service contract with Steris for Steris equipment which this equipment will fall under. Purchasing these two replacements would forego the need to procure another service agreement for a different brand of equipment which would duplicate costs not expected to be recouped through competition.
The Steris company provides trade-in credit for the old equipment which the VA will utilize.
For all of the reasons stated above, in order to limit delay which could negatively impact patient care, the VA will award this order as an emergency sole source order to the OEM, Steris.

(5) Describe Why You Believe the Order Represents the Best Value consistent with FAR 8.404(d) to aid the contracting officer in making this best value determination:
The requirement is available via the Steris Corporation contract V797D-60613,which has been determined to be fair and reasonable. In accordance with FAR 8.405-4, the Government is requesting a price reduction.
Additionally, the current non-operable equipment will be de-installed and the new replacement equipment will be installed by Steris technicians whose experience and training supports the VA’s effort to reach resolution in the most efficient manner.
(6) Describe the Market Research Conducted among schedule holders and the results or a statement of the reason market research was not conducted.
Initial market research located only One source on FSS/VA NAC for the required equipment;
Steris Corporation. Once the Urgent character of the procurement was confirmed, additional market research was stopped and the effort to procure the needed equipment as fast as possible became the mission.
(7) Any Other Facts Supporting the Justification:
Email from the OEM confirm the equipment is produced domestically and is Buy American Statute compliant.
(8) A Statement of the Actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made:
The VA continues to monitor the market and will continue to perform market research and use competitive procedures for requirements that aren’t atypical as this emergency procurement is.
(9) Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge. I understand that processing of this limited sources justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by FAR Subpart 8.4.
