About this file

This document is a Single Source Justification for Simplified Acquisition Procedures for a brand name only procurement of Medtronic microdebrider units for the Iowa City VA Health Care System. The requirement is for a replacement unit and a new unit of the Medtronic 1899200, M5 ROHS microdebrider model. The justification cites the need for standardization with the existing system, urgency to avoid disruption to patient care, and lack of competition as the reasons for the brand name only procurement. The total estimated amount is not provided. The document describes the market research conducted, which found no other sources besides the manufacturer's authorized distributors. The Contracting Officer has certified the justification and determined the price to be reasonable. The related federal contract opportunity is a Request for Quote (RFQ) for the Medtronic microdebriders, issued as a 100% Small Business set-aside.

VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under the SAT

Last Updated: 02/01/22 Page 1 of 2

DEPARTMENT OF VETERANS AFFAIRS

Justification for Brand Name Only - FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C263-24-AP-3475

1. Contracting Activity: Department of Veterans Affairs, Network 23 Contracting Office, 1303 5th St.

Suite 300, Coralville, IA 52241.

Requesting Activity: Iowa City VA Health Care System, 601 Highway 6 West, Iowa City, IA 52246-

Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

-Estimate Amount:

-Microdebriders, P/N 1899200, M5 ROHS, by Medtronic.

-Microdebriders work by employing suction to pull tissue into the aperture of the blade, which cuts the tissue. Suction is used to simultaneously remove tissue-and blood-from the site, allowing much better visibility for the surgeon.

Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

-This requirement is for a replacement unit and a new unit. The unique characteristic that limit availability to only one brand name model is the units will be a part of an existing system of microdebriders currently in place at the requesting medical center. The medical center already has an existing inventory of applicable accessories for the requested model and brand. The required supplies must work seamlessly with the Medtronic IPC microdebrider power consoles already owned and used by the medical center.

-This order requires standardization of equipment to reduce confusion and potential for operating room errors while gaining the benefits that come from familiarity like established competencies, reduced training, and established biomedical experience with the equipment.

-This requirement is urgent. A replacement unit is needed immediately to avoid delays or disruption to patient care. Replacing the established system for a new system of a different brand would cause duplication of costs that will not be recouped through competition.

-For these reasons, the particular microdebrider model requested is essential as the description of this requirement and precludes purchase of a model by another brand.

4. Description of market research conducted and results or statement why it was not conducted:

-GSA/FSS, VA NAC (National Acquisition Center) and VA SAC (Strategic Acquisition Center) Contracts were searched but produced no sources.

-SAM.gov, SVA VetCert.

-The vendor confirmed by letter that the items were available on a Schedule, but it is unfortunately not a Schedule the VA can use.

-The Manufacturer confirmed the brand name model is sold through their authorized distributors in the open market.

-The Manufacturer confirmed the items are produced domestically in the U.S.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.

Note: COs are required to make a determination of price reasonableness IAW FAR 13.106-3. See the S19 Open Market (FAR13) Award Documentation Form with Abstract to document price reasonableness.
