VHAPM Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under the SAT

VHAPM Part 813.106 Page 1 of 2 Original Date: 08/30/17 Revision 02 Eff Date: 03/31/2020

DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C258-21-AP-0661

1. Contracting Activity: Department of Veterans Affairs, NCO 22-Gilbert, Southern Arizona VA Healthcare System (SAVAHCS). PR: 678-21-2-616-0477

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

SAVAHCS Fisher House located at 3601 N. 6th Avenue in Tucson AZ, 85723 requires a hardware and software security upgrade to its current Schneider Electric HVAC control system. Supplies and services required:

• Furnish and install one Schneider AS-P Automation Server Network Controller, Model # SXWASPXXX1001 with Terminal Base, Model # SXWTBBASW110002

• Furnish and install CO2 Sensors and Damper Actuators to Control Outside Air to Air Handling Units.

• Furnish one PowerStream Backup Battery Power Supply.

• Graphic and Programming Enhancements.

• End-User Training.

• Update Control Drawings.

• Annual direct digital controls support agreement for patches and firmware upgrades (First year included with AS-P upgrade).

Estimated Amount: $23,156.65

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

SAVAHCS Fisher House was designed with a Schneider Electric Digital Climate Control System, which includes an Automation Server, Controls, and Thermostats that can only “talk” to each other and are embedded within the facility. In order to replace the Automation Server with another Brand Name component, the entire system would have to be replaced since Schneider Electric's equipment can only operate together as a system.

4. Description of market research conducted and results or statement why it was not conducted:

A Sources Sought Notice was posted on Opportunities on February 22, 2021 to March 1, 2021, that resulted in three (3) responses, one (1) VIP verified SDVOSB and two (2) small business concerns. A review in GSA Advantage found one (1) SDVOSB and 17 Facilities Maintenance and Repair small business concerns under Multiple Award Schedule (MAS) 56120FAC. An SBA Dynamic Small Business Search engine was also conducted to find possible vendors within Pima County, Arizona under NAICS 238210. It revealed there were 9 possible contacts. None of the concerns were Factory Partners authorized to represent Schneider Electric product lines in the State of Arizona (See attached Sole-Source Letter).

The CS talked to Havel Electrical Services and Building Automation’s Director of Automation and Integration, Whitey Reed on March 25, 2021 who said that there were two businesses in the State of Arizona that could provide the services required, Havel and NETSIAN Technologies Group. Digging deeper, the CS found within Schneider’s Product Catalog, information that the company partners with 3,000 certified service providers around the world they trust to deliver their innovative and sustainable solutions (see attached).

On March 21, 2021, the CS received a sole-source letter from, Scott Sharp, Schneider Electric Territory Sales Manager (see attached), stating Havel is the only Schneider Electric Factory Trained Partner representing the EcoStruxure, I/A series, Network 8000 series, DMS series, Continuum series and INET product lines for the State of Arizona that can take on additional requirements. He further states that if an unauthorized contractor obtains and installs Schneider Electric products, Havel cannot support or warrant the products, applications, and implementations. In addition, annual firmware upgrades and patches required each year to operate the system effectively and efficiently are proprietary to Schneider Electric and that Factory Partners are the only authorized entity to install them

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
