About this file
This document is a Justification and Approval (J&A) for Other Than Full and Open Competition from the Department of Veterans Affairs. The sole source procurement is for maintenance services for a Medtronic O-ARM Navigation system located at the Omaha VA Medical Center, with an estimated contract value of $367,625.00. The contract requires the vendor (Medtronic) to provide comprehensive maintenance including corrective maintenance, planned maintenance, and software coverage, ensuring the medical device maintains its FDA certification.
The justification cites 41 USC §3304(a)(1) as the statutory authority, specifically noting that only Medtronic can provide the necessary services due to proprietary software rights and FDA approval requirements. Market research conducted via internet searches found no alternative vendors capable of providing the required maintenance services. The government anticipates that future competitions will remain limited, as software support for such medical devices can typically only be provided by the original manufacturer who obtained FDA 510K approval.
