About this file
This document is a Justification for Single Source Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K) for the acquisition of brand-name AC Pro II trip units made by Utility Relay Company. The Richmond VA Medical Center requires these trip units to safely trip 35 non-functioning main circuit breakers. Market research shows there are not enough SDVOSB or VOSB suppliers to meet the VA Rule of Two, so a Small Business set-aside is recommended with a Lowest Price Technical Accepted award of a Firm-Fixed Contract. The estimated cost for the AC Pro II trip units is $204,186.45.
This document is related to the federal contract opportunity for Trip Units - Utility Relay Company 36C24624Q0838, solicited by the Department of Veterans Affairs Veterans Health Administration Veterans Integrated Service Network 6. The required products are Utility Relays.

DEPARTMENT OF VETERANS AFFAIRS
Justification for Single Source Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: 36C246-24-AP-4065
1. Contracting Activity: Department of Veterans Affairs, VISN 06, Richmond VA Medical Center (652).
This procurement will be processed through the NCO6, Hampton VA Medical Center, 100 Emancipation Drive, Hampton, VA 23667. 2237 # 652-24-3-622-1026
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The
Richmond VA Medical Center has a need for brand-name AC Pro II trip units. AC Pro II provides a means for an operator to safely trip a breaker without having to stand directly in front of the switchgear. They will be used for the 35 main breakers that are not functioning in the medical center right now. The AC Pro II estimated cost is $204,186.45 and it will keep the medical center circuit breakers functioning at full strength.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The AC Pro II are made by Utility Relay Company, work in conjunction with the current breakers at the medical center. This is the only trip unit kit that can handle large number of circuit breakers. Purchasing other band-name trip units will lead to a number of danagerous outcomes such as a short circuit and fire. This would cost the Richmond Medical Center a major setback. A short circuit will put the hospital out of commission and a minimum replacement cost of $10 million dollars and about six months of work to complete. Richmond Medical Center is at risk of fire because there is no protection on these 35 circuits and that puts billions of dollars of equipment at risk.
4. Description of market research conducted and results or statement why it was not conducted: A
Sources Sought was posted on GSAebuy.gov and SAM.gov for Utility Relays. The GSAebuy RFQ 1695132 Sources Sought received one (1) response from M.C. Dean a large business. The Sources Sought Utility Relay 36C24624Q0838 on SAM.gov received two responses for Utility Relays. Virginia Energy & Lighting a SVOSB and 8a business, California Breakers (Cbione) a Small Disadvantaged Business. The Utility Relays market research shows that there are not enough SDVOSBs or VOSBs for competition. The VA Rule of Two could not be met for this requirement. Two small businesses responded to the Sources Sought for the Utility Relays. I recommend a Small Business set-aside, Lowest Price Technical Accepted and award a Firm-Fixed Contract.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
