About this file
This Limited Sources Justification document details a procurement for 12 Kubota Utility Vehicles (Model RTVX2C-SKLH-1) for the St. Cloud Veterans Affairs Medical Center (VAMC) in Minnesota. The total estimated value is $322,658.10, and the procurement will be conducted through the GSA Federal Supply Schedule (Contract Number GS-03F-033AA) under a brand name only requirement. The vehicles will be orange and come with specific accessories including radios, unique ignition key switches, turn signal/hazard lights, strobe light kits, side mirror kits, and a cargo box with glass windows. The justification emphasizes compatibility with existing equipment and spare parts inventory, noting that alternative procurement actions would cause considerable expense to the government. The procurement is supported by market research and requires multiple levels of approval, with digital signatures from the Deputy Chief of Logistics, Contracting Officer, and Branch Chief completed on 24 July 2025.

(4) Identify the Authority and Supporting Rationale (see below and if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
FAR 8.405-6(b): Items peculiar to one manufacturer:
A patent, copyright or proprietary data limits competition. The proprietary data is: Kubota (Brand Name Only) Utility Vehicles with accessories installed.
These are “direct replacements” parts/components for existing equipment.
The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing. Attachments and parts currently in stock need to fit machines being procured.
(5) Describe Why You Believe the Order Represents the Best Value consistent with FAR 8.404(d) to aid the contracting officer in making this best value determination: Any other action would cause considerable expense to the Government as attachments and spare parts inventory is already in place.
(6) Describe the Market Research Conducted among schedule holders and the results or a statement of the reason market research was not conducted. This is a BRAND NAME ONLY PROCUREMENT. Nonmanufacturer Rule applies. A search of Small Business Association DSBS site using NAICS Code 336110 and Kubota yielded zero results for SDVOSB and VOSB. On-line marketing material was viewed to see machine and accessory availability. This item is available on schedule on GSA Advantage on schedule from multiple sources. A few dealers were contacted from the GSA supplier list and responses (2) were that Buy American Act was not an issue and units could be supplied as required.
(7) Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge. I understand that processing of this limited sources justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by FAR Subpart 8.4. (This signature is the requestor’s supervisor, fund control point official, chief of service or someone with responsibility and accountability.)
