DEPARTMENT OF VETERANS AFFAIRS
Justification for BRAND NAME Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: 36C252-21-AP-0387 / 695-21-1-969-0018
Contracting Activity: Department of Veterans Affairs, VISN 12, Zablocki Medical Center (695) has submitted 695-21- 1-969-0018 for Kavo Imaging Cone Beam computed tomography System (CBCT) to the Great Lakes Acquisition Center (NCO12). Jacklyn Bohman from the Logistics will be the Milwaukee contact point & Matthew Hohl from NCO12 will be responsible for the Contracting Action.
1. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:
This justification and approval is for a Brand Name KAVO – Kavo OP3D (CBCT) procurement which will be set-a-side for Small Businesses and awarded as a firm-fixed-priced purchase order. This system is used to produce dental imaging scans which assist the Clinician with the planning of procedures & treatment plans. This order is estimated
2. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
Zablocki Medical Center (Dental lab) is requesting the purchase of a KAVO – Kavo OP3D (CBCT) that will be used to produce dental image scans. This equipment will provide the Milwaukee Dental Lab continuity as the clinical staff are already trained on this product/brand. The Zablocki Medical center has two dental labs with one located at the Milwaukee location and the other at Green Bay Outpatient clinic. Both locations are currently utilizing the Kavo brand but the Milwaukee equipment is malfunctioning and the manufacturer is unable to remediate. The KAVO brand has a proprietary X-ray software CLINCIVIEWTM which allow all providers to use the implant planning software to share, plan, and edit the scans in order to have continuity of care for the patient with no loss of data. If another brand was selected it would limit the ability to share scans between the sites. This would create additional training for the clinicians/staff utilizing this equipment and if a surgery is moved from Green Bay to Milwaukee the veteran would need to be duplicate the scan at the Milwaukee facility prior to surgery. It has also been identified that the disposable items are already stocked by logistics (bite sticks). If a different brand was to be selected it would create the need to purchase/stock the new brand’s disposable items which would be an additional cost for the government.
3. Description of market research conducted and results or statement why it was not conducted:
Market research was conducted which showed only one SDVOSB Authorized Distributor was available to distribute this brand. The company Webco was presented as a SDVOSB vendors but the profile was not found in the Vendor information page, therefor they do not meet the requirement to be considered SDVOSB. The Non-Manufacturer Rule was reviewed, it was found this manufacturer is an Other Than Small Business (OTSB) with NIACS Code 339114 / PCS 6520. Market Research also showed there is not a waiver for these codes either, therefore this procurement qualifies under 13 CFR §121.406(c). Based on the information provided above, it is determined this procurement shall be set-aside for Small business (open market), and that the award can be made at a fair and reasonable price that offers the best value to the United States IAW 13 CFR § 121.406(c), FAR 13.106- 1(d), and FAR 19.502-2.
